2.12.010 Planning commission created.

Pursuant to ORS 227.010 through 227.090, there is hereby created a commission to be primarily involved in community planning and development issues and to have those powers and duties specified in ORS 227.090 and more specifically outlined in the city of Phoenix Land Development Code and other city regulations. This commission shall be known as the planning commission.

2.12.020 Powers and duties.

The commission shall have all the powers which are now or hereafter granted to it by ordinances of this city or by general laws of the state of Oregon. The commission shall control the subdivision of land and may make recommendations to the city council, to public officials and to individuals regarding land use; location of thoroughfares, public buildings, parks and other public facilities; and regarding any other matter relating to the planning and development of the city and the surrounding area. The commission may make studies, hold hearings and prepare reports and recommendations on its own initiative or at the request of the city council.

2.12.030 Membership; compensation.

The planning commission shall consist of seven members to be appointed by the mayor with the consent of the city council. Two members may live outside the city limits of Phoenix, but must live within the city’s acknowledged urban growth boundary. Commission members shall receive no compensation.

2.12.040 Terms of office; vacancies.

Terms of office on the commission shall be four years and shall expire on December 31st of the fourth year. A vacancy shall be filled by the mayor with the consent of the city council and that appointee shall serve the unexpired portion of the term.

2.12.050 Officers.

The planning commission shall, at its first meeting of each calendar year, elect a chair and vice-chair. The chair and vice-chair shall be appointed members. The planning commission secretary shall be a planning department staff member.

2.12.060 Duties of chair and vice-chair.

The chair shall preside at all meetings and shall sign final orders of the planning commission within ten working days of the planning commission decision, unless directed otherwise by the planning commission. The vice-chair shall perform the duties of the chair in the absence of the chair and such other duties as may be assigned by the chair.

2.12.070 Recommendations to be in writing.

All recommendations and suggestions made to the city council by the commission shall be in writing.

2.12.080 Minutes; report.

The secretary shall keep an accurate record of all commission proceedings, including written minutes of all meetings. A copy of the minutes of each planning commission meeting shall be a public record and available for inspection.

2.12.090 Quorum; meetings; rules.

A majority of the commission members, then appointed, but not less than three constitute a quorum. The commission may adopt rules of procedures consistent with the law and its regular schedule of meetings shall include at least one meeting per month, unless canceled at the direction of the chair due to lack of commission business or other reason.

2.12.100 Absence from meetings.

Commission members are encouraged to attend all regular scheduled planning commission meetings. To that end, unexcused absence from three, or excused absence from four consecutive regular meetings will result in a recommendation of dismissal to the city council. If the city council determines that dismissal is appropriate, the following procedure shall be followed:

A.    The position will be declared vacant and the member notified, in writing, of the decision of the council.

B.    Council will request, in writing, that the member return all material on loan, within fourteen days, or pay a replacement fee, based on council policy.

2.12.110 Expenditure authorization.

The commission shall have no authority to make expenditures on behalf of the city, or to obligate the city for the payment of any sums of money, except as herein provided, and then only after the city council shall have first authorized such expenditures by appropriate ordinance (or resolution) which ordinance (or resolution) shall provide the administrative method by which such funds shall be drawn and expended.
