12.12.010 Repaved street – Excavation prohibited by five years.

There shall be no excavation in newly paved or resurfaced streets by anyone other than the city for a period of five years from the date of such paving.

12.12.020 Notice of paving or resurfacing required.

At least ninety days before any streets are paved or resurfaced the staff shall give notice of such plans to any utility company or other person that has requested to be so notified. In addition, such notice shall be given by mail to the owners of all property abutting on such streets and it shall be sent to their last known addresses.

12.12.030 Exception.

The city council may permit excavation within the five-year period if, in its judgment, the reason for the excavation was not reasonably foreseeable to the utility or applicant involved at the time the street was newly paved or resurfaced. Where an emergency involving the public health or safety requires immediate excavation the city manager/recorder may permit such excavation and fully report to the city council at its next council meeting.

12.12.040 Copy of ordinance to public utilities.

The city manager/recorder is directed to furnish a copy of the ordinance codified in this chapter to each public utility or similar agency that does business in the city.

12.12.050 Violation--Penalty.

Any person, firm or corporation in violation of any provision of this chapter, shall be punished upon conviction by a fine pursuant to Section 1.20.020 of this code.
