15.20.010 Fencing – Required.

Every person in possession of land within the city, either as owner, purchaser under contract, lessee, tenant or licensee, on which there is situated an excavated or portable swimming pool which contains water eighteen inches or more in depth at any point, shall erect and maintain on the lot or premises on which the pool is located, an adequate fence or wall sufficient to make the pool or body of water inaccessible to small children.

15.20.020 Fencing – Construction.

The fence or wall including gates therein, shall be solid wall, picket, vertical board, or of chain-link type construction and shall completely surround such pool or body of water. The fence shall be not less than four and one-half feet above the underlying ground with openings, holes or gaps therein, no larger than four inches in any dimension, except for doors or gate; provided, however, that if a vertical board or picket fence is erected or maintained, the horizontal dimensions shall not exceed four inches, provided, further that a dwelling house or accessory building may be used as a part of such enclosure.

15.20.030 Gates.

All gates or doors opening through the enclosure except the door of any dwelling occupied by human beings and forming any part of the enclosure required in this chapter, shall be equipped with a self-closing and self-latching device designed to keep and capable of keeping the door or gate securely closed at all times, when not in actual use. The self-latching device shall be placed not less than four and one-half feet above the underlying surface or otherwise made inaccessible from the outside by small children.

15.20.040 Wall--Exception.

If the exterior walls of a portable or raised swimming pool are vertical and extend at least fifty-four inches above the grade of the abutting ground at all points, no further fencing shall be required except such as will be necessary to enclose the ladder, steps or other such access to the pool.

15.20.050 Compliance required.

All swimming pools constructed in the future shall comply with this chapter before they are filled with water. All persons maintaining presently existing pools shall comply with the requirements of the ordinance codified in this chapter by June 1, 1969.

15.20.060 Provisions additional to other requirements.

This chapter shall not be construed as amending, either expressly or by implication Chapter 15.12.

15.20.070 Violation--Penalty.

Violation of any provision of this chapter shall be punished upon conviction by a fine pursuant to Section 1.20.020 of this code.
