8.05.010 Permit required for entry.

It shall be unlawful for any person or persons at any time to enter the city of Rainier watershed property lying either above or below the existing city-owned dam, without having first obtained a license and permit so to do from either the office of the city recorder or the chief of police of the city of Rainier, as herein provided. (Ord. 668 § 1, 1958)

8.05.020 Application for permit.

A license and permit to enter the aforementioned city of Rainier watershed property may be obtained, without charge from the city recorder’s office, or from the chief of police, in the absence of the city recorder.

All applications for such permits shall set forth the following:

A. Name, address, and phone number of applicant.

B. Purpose of visit.

C. Time and date of proposed entry into the property and estimated time of departure therefrom.

D. Approximate location of area to be visited.

No permit so issued as herein provided shall be valid longer than 12 hours from the date of issuance, unless an extension thereof is endorsed in writing upon the face of said permit by the city recorder or chief of police of the city of Rainier. (Ord. 668 § 2, 1958)

8.05.030 Permit does not remove liability.

Issuance of the foregoing permits shall not relieve any permittee from any liability to the city of Rainier for damages of whatsoever nature caused by the misfeasance, nonfeasance, or negligence of the permittee. (Ord. 668 § 3, 1958)

8.05.040 Exclusions.

The licensing provisions of this chapter shall not apply to any employees, agents, representatives or councilmen of the city of Rainier who shall enter said premises on official business, or for inspection purposes for the city of Rainier. (Ord. 668 § 4, 1958)

8.05.050 Violation – Penalty.

Any unlicensed entry into the said city of Rainier watershed by any person or persons shall be deemed a misdemeanor and upon conviction thereof, any such person or persons shall be fined in a sum not exceeding $100.00, or by imprisonment in the city jail for not exceeding 10 days, or by both such fine and imprisonment.
