RIVERFRONT PARK AND BEACH AREA – DRIVING PROHIBITED*

10.20.010 Definitions.

For purposes of this chapter, the following definitions apply:

“Motor vehicle” means every vehicle that is self-propelled, including tractors, fork-lift trucks, motorcycles, road-building equipment, street cleaning equipment, and any other vehicle capable of moving under its own power, notwithstanding that the vehicle may be exempt from licensing under the motor vehicle laws of Oregon.

“Person” means a natural person, firm, partnership, association or corporation.

“Riverfront Park and Beach Area” means that property described in Exhibit A which is attached to the ordinance codified in this chapter. (Ord. 865 § 1, 1982)

10.20.020 Driving on Riverfront Park prohibited.

No person shall drive, store or park a motor vehicle on that property described in Exhibit A attached to the ordinance codified in this chapter. (Ord. 865 § 2, 1982)

10.20.030 Public danger.

Under conditions constituting a danger to the public, the public works supervisor or his designee shall install sign or notice devices considered by him to be necessary to implement this chapter. (Ord. 865 § 3, 1982)

10.20.040 Authority of police and fire officers.

A. It shall be the duty of police officers to enforce the provisions of this chapter.

B. In the event of a fire or other public emergency, officers of the police and fire department may travel on the property described in Exhibit A attached to the ordinance codified in this chapter, notwithstanding the provisions of this chapter. (Ord. 865 § 4, 1982)

10.20.050 Exemption.

The provisions of this chapter shall not apply to a vehicle of the city, county or state or public utility while necessarily in use for construction or repair work in, on or around the property described in Exhibit A attached to the ordinance codified in this chapter. (Ord. 865 § 5, 1982)

10.20.060 Violation – Penalty.

Violation of a provision of this chapter is punishable by a fine not to exceed $1,000, or by imprisonment not to exceed 30 days, or both. Violation of a provision identical to a state statute is punishable by fine not to exceed the penalty prescribed by the state statute. (Ord. 865 § 6, 1982)
