15.05.010 Conformity to State Building Code standards.

In addition to compliance with this chapter and other city ordinances, building and related activities shall comply with the State Building Code standards, adopted by the Director of the Oregon Department of Commerce, and the Fire and Life Safety Code standards, adopted by the State Fire Marshal, as these codes apply at the time of the building or related activity. No person may undertake building or related activities without compliance with these standards. (Ord. 905 § 1, 1987)

15.05.020 Local administration of building code.

The city shall provide a program of specialty code administration, including plan checking, permit issuing and inspection, as provided by the state regulations for building code administration and this chapter, for structural and mechanical work. (Ord. 905 § 2, 1987)

15.05.030 Local interpretation.

A. In addition to the provisions of Section 105 of the State Structural Specialty Code and similar provisions of other specialty codes administered by the city, the building official may approve a material or a method of construction not specifically prescribed by this chapter after finding that the proposed design meets the criteria for approval. In lieu of making a finding, the building official may refer the proposed design to the city board of appeals.

B. A person affected by a ruling of the building official may appeal the ruling to the board of appeals within 30 days of the date of the ruling.

C. The city recognizes that a person may request a ruling from the director of the Department of Commerce prior to submitting an application to the city for a permit or after withdrawing a previously submitted application. (Ord. 905 § 3, 1987)

15.05.040 Unsafe buildings.

The law referred to in Section 203 of the state of Oregon Structural Specialty Code and Fire and Life Safety Code is the ordinance codified in Chapter 15.15 RMC. (Ord. 905 § 4, 1987)

15.05.050 Fees.

The fees charged by the building official shall be the same as fees that would be charged if the state were performing the enforcement. The building official shall maintain a fee schedule to carry out this policy. (Ord. 905 § 5, 1987)

15.05.060 Violation – Penalty.

A. No person shall:

1. Violate or aid in the violation of a final order concerning the application of a State Building Code provision in a particular case made by the city administrative officer, appeals board, building official or inspector.

2. Engage in or aid a person in an activity for which an authorization is required by a specialty code or other regulation established by this chapter without first obtaining authorization.

B. A violation of subsection A of this section is punishable by a fine not to exceed $500.00. (Ord. 905 § 6, 1987)
