10.30.010 On-street and city-owned parking lot parking permits.

A. The council, by resolution, may authorize issuance of parking permits for on-street and certain city-owned parking lots for the parking of motor vehicles for a time or in a manner which would otherwise constitute a violation of the provisions of this chapter. The fees for such permits shall be prescribed by resolution of the council.

B. Such permits shall set forth the time, place, and manner in which vehicles may be parked.

C. A vehicle may be lawfully parked under a permit issued pursuant to this section only to the extent that it is parked in compliance with all conditions and restrictions imposed thereon, the terms of which shall be strictly construed.

D. The city manager shall have the authority to implement regulations necessary to carry out this chapter. (Ord. 03-103 § 2, 2003)

10.30.020 Violation of regulations prohibited.

It shall be unlawful for any person to violate any regulation implemented by the city manager pursuant to this chapter. (Ord. 03-103 § 2, 2003)

10.30.030 Parking with on-street and city-owned parking lot parking permit.

Notwithstanding any other provision of this code to the contrary, the holder of a valid parking permit for on-street or city-owned parking lots designated for permit parking may park a vehicle at a place, for a time, or in a manner which would otherwise constitute a violation of the provisions of this chapter if:

A. The holder parks only at the location, in the manner, at the times, and in compliance with the conditions specified in the permit; and

B. While a vehicle for which an on-street or city-owned parking lot permit has been issued is so parked, such permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A parking permit shall not guarantee or reserve to the holder any given on-street or city-owned parking lot parking space. An on-street or city-owned parking lot parking permit shall not authorize the holder thereof to stop, stand or park a motor vehicle in such places or during such times as the stopping, standing, or parking of motor vehicles is prohibited or set aside for specified types of vehicles, nor exempt the holder from the observance of any traffic regulation other than parking time limits. 10.30.040 Restricted parking violations.

It shall be unlawful for any person to park a vehicle in a space designated as permit parking only without displaying a valid parking permit. It shall further be unlawful for a person to represent that he or she is entitled to a parking permit for on-street or city-owned parking lots when that person is not so entitled, or for a person to fail to surrender a permit to which he or she is no longer entitled, or for a person to park a vehicle displaying such a permit at any time when the holder of such permit is not entitled to hold it. 10.30.050 Revocation of permit.

A. The city manager is authorized to revoke a parking permit for on-street or city-owned parking lots if the holder of the permit is found to be in violation of this chapter. Upon written notification thereof, the permit holder shall surrender such permit to the city manager.

B. Failure to surrender a parking permit that has been revoked shall constitute a violation of this chapter. (Ord. 03-103 § 2, 2003)

10.30.060 Creation of residential permit parking zone.

Whenever the city manager shall make a determination that a residential area is impacted by commuter vehicles, the manager may initiate action to create a residential permit parking zone. (Ord. 03-103 § 2, 2003)

10.30.070 Considerations.

In recommending whether an area shall be designated as a residential permit parking zone, the following factors shall be taken into consideration:

A. The desire and need of the residents for residential permit parking.

B. The need for parking in proximity to establishments located therein and used by the general public for religious, health, business or educational purposes. (Ord. 03-103 § 2, 2003)

10.30.080 Issuance of permits – Erection of signs.

Following approval of the designation of a residential permit parking zone, the city manager shall cause parking signs to be erected in the zone, indicating the times and locations where parking shall be permitted by permit. The city manager shall issue appropriate permits. A permit shall be issued upon application only to the owner or the operator of a motor vehicle who resides on property immediately adjacent to a street or other location within the residential permit parking zone. There shall be no charge for the permit other than a processing fee in an amount set by resolution of the council. The application for a permit shall contain the name of the owner or operator of the motor vehicle, residential address, the motor vehicle’s make, model, and the applicant’s driver’s license number. The owner or operator of any motor vehicle applying for a residential parking permit shall have a current and valid Oregon vehicle registration. The permit shall be renewed annually upon such conditions and procedures as the city manager shall specify. The permit shall be displayed on the inside rear view mirror of the vehicle. 10.30.090 Restricted parking violations in residential permit parking zones.

It shall be unlawful for any person:

A. To represent falsely that the person is entitled to a residential parking permit or to fail to surrender a permit to which the person is no longer entitled; or

B. To park a vehicle displaying such a permit at any time when the holder of such permit is not entitled to it; or

C. To park in a designated residential permit parking zone without display of a permit issued pursuant to this chapter; or

D. To park without display of a permit in a limited time parking zone within a residential permit parking zone for a period in excess of that listed in a parking control device. (Ord. 03-103 § 2, 2003)

10.30.100 Revocation of permit.

The city manager is authorized to revoke a parking permit for on-street or city-owned parking lots if the holder of the permit is found to be in violation of this chapter. Upon written notification thereof, the permit holder shall surrender such permit to the city manager. Failure to surrender a parking permit that has been revoked shall constitute a violation of this chapter. (Ord. 03-103 § 2, 2003)

10.30.110 Unauthorized use of parking permits.

A. It shall be unlawful for any person to copy, reproduce, or alter any parking decal, form, sticker, or other device used by the city of Silverton pursuant to the provisions of this chapter.

B. It shall be unlawful for any person to use any altered, forged, or expired permit on any vehicle for the purpose of representing that such vehicle is in compliance with any section of this chapter which requires a sticker, form, decal, or other device when that vehicle and the owner are not so entitled. 10.30.120 Unauthorized parking control devices.

It shall be unlawful for any person to place, erect, paint, inscribe, or otherwise establish any parking control device which purports to restrict or control parking, except such parking control devices as are authorized by this code or the laws of the state of Oregon and the city of Silverton.
