12.28.010 Obstructing public ways by storing personal property.

No person shall, except as otherwise permitted by ordinance, obstruct, cause to be obstructed, or assist in obstructing pedestrian or vehicular traffic on any sidewalk or street by deposit or storage thereon of personal property. (Ord. 467 § 15(1), 1962)

12.28.020 Delivery of personal property – Exemptions.

The provisions of this chapter shall not apply to the delivery of merchandise or equipment; provided, that no person shall permit such merchandise or equipment to remain on any street or sidewalk beyond a reasonable time. (Ord. 467 § 15(2), 1962)

12.28.030 Warning lights required when.

No person shall, from sunset to sunrise, permit any merchandise, equipment or other obstruction to remain on any street or sidewalk unless a warning light or lights are placed by such obstruction in such a position as to be clearly visible for a distance of at least 200 feet both ways; provided, however, that such obstructions will be allowed only upon express authorization obtained from the chief of police when such obstruction will not unduly hinder or impede traffic. 12.28.040 Selling, storing or displaying merchandise.

No person shall use any street or sidewalk, or portion thereof, for selling, storing or displaying merchandise or equipment except as follows:

A. Merchandising in the public right-of-way shall be allowed only in the commercial districts on the public sidewalk along the business frontage of an associated ground level retail space; provided, that all products are sold within the principal use, all merchandise and related fixtures are removed from the right-of-way at the end of the business’s hours of operation, and the use does not encroach on door openings, drive aisles, parking areas, loading zones or fire lanes, and maintains a 60-inch unobstructed pedestrian way.

B. Placement of all merchandise must also adhere to the requirements of the Americans with Disabilities Act and all other applicable standards and shall not unreasonably obstruct sidewalk spaces or inhibit the free passage in such areas. All merchandise and/or supporting structures must be placed on the ground, and may not be affixed exclusively to the face of the building. Displays of merchandise may not obstruct ingress to or egress from the building.

C. Merchandise and supporting structures shall not project more than two feet from the property line of the building housing the permanent retail operation.

D. All merchandise and supporting structures shall be kept clean and in good repair.

E. No electricity may be used in conjunction with the display of merchandise, for artificial light or any other purpose. Electrical goods which are not plugged in may be displayed.

F. Any merchandising display must be removed whenever required by city personnel.

G. Any merchandise otherwise prohibited from being sold outdoors shall be prohibited from being displayed and sold under this section. (Ord. 14-05 § 1, 2014; Ord. 467 § 15(4), 1962)

12.28.050 Depositing earth or debris on streets or sidewalks.

No unauthorized person shall deposit any earth, gravel or debris upon any street or sidewalk. (Ord. 467 § 15(5), 1962)
