15.05.010 State building code adopted.

The city of Sisters hereby adopts the state building codes, ORS Chapter 455 and Oregon Administrative Rules adopted thereunder. The city of Sisters will enforce this code and the applicable rules. [Ord. 345 § 1, 2004].

15.05.020 Uniform Building Code for Excavation and Grading adopted.

The city of Sisters hereby adopts the Uniform Building Code, Appendix Chapter 33, Excavation and Grading. [Ord. 345 § 2, 2004].

15.05.030 Building permit fees established.

Building permit fees will be established in accordance with ORS Chapter 455. The fees will be set by resolution of the council following a public hearing. [Ord. 345 § 3, 2004; Ord. 313 § 1, 2000; Ord. 275 § 5, 1996; Ord. 261 § 3, 1993. Code 2002 § 15.04.040].

15.05.040 Investigative authority and corrective action of building official and inspector.

In addition to any other authority and power granted to the building official or delegated inspector under the specialty codes adopted by this chapter, except where inconsistent with other provisions of the law, the building official or delegated inspector may enforce the provisions of specialty codes against any person regardless of whether a permit, certificate, license or other indicia of authority has been issued. The building official or delegated inspector may investigate, order corrective action and if an immediate hazard to health and safety is imminent, issue an order to stop all or any work under the applicable specialty code. 15.05.050 Penalties.

(1) No person shall:

(a) Violate or aid in the violation of a final order concerning the application of a specialty code provision in a particular case made by the city administrative officer, appeals board, building official or inspector.

(b) Engage in or aid a person in an activity for which a permit, certificate, label or other authorization is required by specialty code or other regulation established by this chapter without first obtaining such permit, certificate, label or other formal authorization.

(2) A violation of Sisters City Code Section 15.060 et seq. is punishable by a fine not to exceed $1,000. Each seven continuous days that a violation of this chapter continues is a separate offense. [Ord. 275 § 6, 1996; Ord. 261 § 5, 1993. Code 2002 § 15.04.050].

15.05.060 Severability.

The council declares that should any section, paragraph, sentence, or word of this code be declared for any reason to be invalid, it is the intent of the council that it would have passed all other portions of this chapter, independent of the elimination of any such portion as may be declared invalid.
