Fire Prevention

§10-601 Purpose.

This Article is intended to promote the public health, safety and welfare of the citizens of Cornwall Borough, particularly to prevent actions which may result in fires. This Article is enacted in accordance with Sections 1202(15) and 1202(17) of the Borough Code, 8 Pa. C.S. §§1202(15), 1202(17).

§10-602 Definitions.

Unless the context specifically indicates otherwise, the meaning of terms used in this Article shall be as follows:

Borough – the Borough of Cornwall, Lebanon County, Pennsylvania, a Pennsylvania municipality acting by and through its Council or, in appropriate cases, acting by and through its authorized representatives.

Owner – any person vested with ownership, legal or equitable, sole or partial, of any property.

Person – any individual, firm, partnership, company, association, society, corporation, limited liability company, or other group or legal entity.

Property – any lot or parcel of land within the Borough.

§10-603 Throwing or Placing Sources of Ignition.

No person shall throw or place, or cause to be thrown or placed, a lighted match, cigar, cigarette, matches, firework, or other flaming or glowing substance or object on any surface or article where it can cause an unwanted fire.

§10-604 Aerial Discharges.

No person shall discharge, set off, use, or otherwise cause any pyrotechnic, firework, or other projectile which is a source of ignition to be sent into the air within the Residential Forest District as established on the Official Zoning Map. No person shall discharge, set off, use, or otherwise cause any pyrotechnic, firework, or other projectile which is a source of ignition into the air at any location in the Borough during any period when open burning is prohibited.

§10-605 Borough Property.

No person shall discharge, set off, or use any pyrotechnic or firework on any property owned or controlled by the Borough, including but not limited to streets, without the prior express consent of the Borough.

§10-606 Responsibility of Owners of Property.

The owner of each property shall be responsible for all acts of tenants or other occupants of such improved property insofar as such acts shall be governed by provisions of this Article.

§10-607 Violations and Penalties.

Any person who or which shall violate or assist or permit any other person to violate any of the provisions of this Article shall, upon conviction thereof in a summary proceeding, be sentenced to pay a fine of not less than $100 nor more than $1,000, plus costs, including the Borough’s reasonable attorneys’ fees incurred in the enforcement proceeding. Each day that a violation continues shall constitute a separate violation. Each Section of this Article violated shall constitute a separate violation.
