Designation of Emergency Service Providers

§7-101 Authority.

This Part is adopted pursuant to authority granted by 53 P.S. §46202(35) and (74) of the Borough Code, as amended, and to conform to the legal requirements of 42 Pa.C.S.A. §8541, as amended.

§7-102 Purpose.

This Part is adopted to promote and protect the health, safety and welfare of the residents of Selinsgrove Borough by acknowledging Dauntless Hook & Ladder Fire Company as the official, primary response, municipal firefighting service and D. H. & L. Ambulance League as the official, primary response, emergency medical service for the borough and thereby extend local governmental agency immunities to such company and league.

§7-103 Definitions.

Unless the context specifically and clearly indicates otherwise, the meanings of the terms used in this Part shall be as follows:

Borough–Selinsgrove Borough, Snyder County, Pennsylvania. [Ord. 706]

Municipal emergency medical services–any and all medical services on an emergency basis, including but not limited to quick response, rescue, medical care, first aid, trauma management, life support, fund-raising and related activities and functions.

Municipal firefighting services–any and all firefighting services including but not limited to firefighting, rescue, crowd control, fire police, fund-raising and related activities and functions.

Person–a natural person, partnership, association, corporation, trust, company, firm or other legal entity. [Ord. 706]

§7-104 Dauntless Hook & Ladder Fire Company.

1.    Dauntless Hook & Ladder Fire Company has been in existence for over 50 years, having been created as is required and permitted by law.

2.    Dauntless Hook & Ladder Fire Company has been acting as, has officially been and continues to be the primary response municipal firefighting service for this political subdivision for which it has served for over 50 years.

3.    Dauntless Hook & Ladder Fire Company presently is and shall be the official municipal firefighting service for this municipality until further resolution, ordinance or other official act of this Borough.

§7-105 D. H. & L. Ambulance League.

1.    D. H. & L. Ambulance League has been in existence for over 30 years, having been created as is required and permitted by law.

2.    D. H. & L. Ambulance League has been acting as, has officially been and continues to be the primary response, municipal, emergency medical service for this political subdivision for which it has served for over 10 years.

3.    D. H. & L. Ambulance League presently is and shall be the official municipal emergency medical service for this municipality until further resolution, ordinance or other official act of this Borough.

§7-106 Nonliability for Debt.

By enactment of this Part and acknowledgment of Dauntless Hook & Ladder Fire Company and D. H. & L. Ambulance League, Selinsgrove Borough in no way accepts nor shall it be deemed to accept any liability or responsibility for the contractual debts and obligations of the company and/or league, and the company and league shall be solely responsible for and shall pay according to their terms any and all notes, bonds, mortgages, contracts and other obligations for which it contracts.

§7-107 Authorization to Recover Costs and Expenses.

The Dauntless Hook & Ladder Fire Company is hereby authorized to recover any and all costs of firefighting materials, including, but not limited to, hazardous situation abatement materials, used and expended, the costs for the use of the fire trucks, fire engines, ladder trucks, rescue vehicles, rescue equipment and tankers, and the cost of personnel hours involved in or related to any municipal firefighting service, fire, safety, rescue incident or operation, and/or hazardous abatement incident, including, but not limited to, vehicular accidents and fires, within the Borough.

§7-108 Schedule of Fees and Costs.

The Dauntless Hook & Ladder Fire Company is hereby authorized to charge any person the fees and costs set forth on Schedule 7-1-A attached hereto and incorporated herein by this reference. These fees and costs may be charged and invoiced to any person, or his, her or its insurance carrier or personal representative, for whom or for whose property such services and/or materials were provided. By resolution of Borough Council properly made, seconded and carried at any of its regular or special meetings, Schedule 7-1-A may be amended from time to time, and such resolution shall have the same force and effect as if fully set forth herein.

§7-109 Collection Costs and Enforcement.

The Dauntless Hook & Ladder Fire Company may collect the fees and costs set forth in Schedule 7-1-A by direct billing or by such other lawful means it deems appropriate. The Dauntless Hook & Ladder Fire Company is further authorized to bring an action in any court of competent jurisdiction for the collection of any and all amounts due under Schedule 7-1-A, plus legal interest thereon and reasonable attorney’s fees, from any person who received municipal firefighting services and other materials and services covered by Schedule 7-1-A which have not been paid as requested.
