On-Lot and Community Disposal System

§18-101 Permit Required.

No person shall install an individual or community sewage disposal system or construct any building in the Borough of Selinsgrove in which an individual or community sewage disposal system is to be installed, without first obtaining a permit indicating that the site, plans and specifications of such system are in compliance with the Pennsylvania Sewage Facilities Act 537, 35 P.S. §750.1 et seq., and the rules and regulations adopted pursuant to the Act.

§18-102 Fees and Penalties.

The Borough Council shall from time to time, by duly adopted resolution, determine and impose such fees and costs as it deems necessary and permitted by the Act for the services rendered, the applications reviewed and permits issued in accordance with the Act. Any person who violates or fails to comply with any rule or regulation adopted by the Borough by resolution or imposed by the Act shall be guilty of a summary offense and shall be subject to the fines and penalties provided for in §13 of the Act, as amended, 35 P.S. §750.13.

§18-103 Percolation Tests and Inspections.

Percolation tests and other inspections under this Part within the limits of the Borough of Selinsgrove may be made by any individual qualified by the Commonwealth of Pennsylvania, Department of Health, to make such tests, said individual to make report of said tests to the Borough and to the Commonwealth of Pennsylvania, Department of Health.

§18-104 Hearing upon Denial or Revocation of Permit.

In case any permit is denied or revoked, a hearing shall be held thereon before the Borough Council of this Borough within 15 days after request thereof is made by the applicant. Within 7 days following the date of such hearing the applicant shall be notified in writing of the determination of said hearing.

§18-105 Violations and Penalties.

Any person who shall violate any of the provisions of this Part or of the Pennsylvania Sewage Facilities Act, 35 P.S. §750.1 et seq., which is incorporated herein by reference or the rules, regulations and standards promulgated there under or who resists or interferes with any inspector or other officer, agent or employee of this Borough in the performance of his duties under this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $100 nor more than $1,000 plus costs and reasonable attorney fees incurred by the Borough in the enforcement proceeding and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.

§18-106 Borough Sewage Enforcement Officers.

The Borough Council is hereby authorized to engage the services of sewage enforcement officers licensed by the Commonwealth of Pennsylvania to perform any and all of the services and comply with all of the requirements of the Borough under the Act at such rate of compensation as the Borough and those officers may mutually agree upon.
