General Provisions

§22-101 Title and Short Title.

1.    Title. An ordinance of the Borough of Selinsgrove establishing rules, requirements, standards, and procedures to govern the subdivision of land and land developments within the Borough of Selinsgrove, Snyder County, pursuant to the authority granted in Article V of the Pennsylvania Municipalities Planning Code, Act 247, 53 P.S. §10501 et seq., which grants the governing body of each municipality the power to regulate such activities by enacting a subdivision and land development ordinance.

2.    Short Title. This Chapter shall be known and may be cited as the “Selinsgrove Borough Subdivision and Land Development Ordinance.”

§22-102 Authority and Jurisdiction.

1.    Authority. Article V of the Pennsylvania Municipalities Planning Code of July 31, 1968, in General Assembly, Act No. 247, 53 P.S. §10501 et seq., as amended, empowers the Borough Council of Selinsgrove Borough to regulate subdivisions and land development.

2.    Jurisdiction. In accordance with §507 of Act 247, the Pennsylvania Municipalities Planning Code, 53 P.S. §10507, no subdivision or land development of any lot, tract, or parcel of land shall be made, no street, sanitary sewer, storm sewer, water main, or other improvement in connection therewith shall be laid out, constructed, opened, or dedicated to public use or travel, or for the common use of occupants abutting thereon, except in accordance with the provisions of this Chapter.

§22-103 Statement of Purposes.

1.    To assist orderly, efficient and integrated development of the Borough.

2.    To promote the health, safety, and general welfare of the residents of the Borough.

3.    To ensure conformance of land subdivision plans with the public improvement plans of the Borough.

4.    To ensure coordination of inter-municipal public improvement plans and programs.

5.    To encourage well-planned subdivisions by establishing adequate standards for design and improvement.

6.    To improve land records by establishing standards for surveys and plans.

7.    To safeguard the interests of the public, the homeowner, and the subdivider.

8.    To secure equitable handling of all subdivision plans by providing uniform procedures and standards.

§22-104 County Review.

All applications for subdivision and land development within the Borough shall be forwarded by the Borough Planning Commission, upon receipt, to the Snyder County Planning Commission for review and report at applicant’s expense. Such action shall occur at the preliminary plan stage, and the Borough shall not approve a plan until the County report is received or until the expiration of 30 days from the date of the application was forwarded to the Snyder County Planning Commission.

§22-105 Plan Approval.

1.    The Borough Planning Commission is hereby designated by the Borough Council as the agency which shall review and make recommendations on all preliminary and final plans as required herein.

2.    The Borough Council shall have authority to approve all preliminary and final plans as required herein.

§22-106 Powers and Duties of the Planning Commission.

1.    The Planning Commission shall have the power to:

A.    Prepare the Comprehensive Plan in accordance with the Code and present it for consideration to the Borough Council.

B.    Maintain and keep on file records of its action. All records and files of the Planning Commission shall be in the possession of the Borough Council.

2.    The Planning Commission, at the request of the Borough Council may:

A.    Make recommendations to Borough Council concerning the adoption or amendment of an official map.

B.    Prepare and present to the Borough Council a zoning ordinance, and make recommendations to the Borough Council on proposed amendments to it as set forth in the Code.

C.    Prepare, recommend, and administer subdivision and land development and planned land development regulations as set forth in the Code.

D.    Prepare and present to the Borough Council a building code and a housing code and make recommendations concerning proposed amendments thereto.

E.    Do such other acts or make such studies as may be necessary to fulfill the duties and obligations imposed by the Code.

F.    Prepare and present to the Borough Council an environmental study.

G.    Submit to the Borough Council a recommended capital improvement program.

H.    Prepare and present to the Borough Council a water survey, which shall be consistent with the State Water Plan and any applicable water resources plan adopted by a river basin commission for the Susquehanna River. The water survey shall be conducted in consultation with any public water supplier in the area to be surveyed.

I.    Promote public interest in and understanding of the Comprehensive Plan and planning.

L.    Make recommendations to governmental, civic, and private agencies and individuals as to the effectiveness of the proposals of such agencies and individuals.

M.    Hold public hearings and meetings.

N.    Present testimony before any board.

O.    Require from other departments and agencies of the Borough such available information as relates to the work of the Planning Commission.

P.    In the performance of its functions, enter upon any land to make examinations and surveys with the consent of the owner.

Q.    Prepare and present to the Borough Council a study regarding the feasibility and practicability of using renewable energy sources in specific areas in the Borough.

R.    Review the Zoning Ordinance [Chapter 27], Subdivision and Land Development Ordinance [this Chapter], Official Map, provisions for planned residential development, and such other ordinances and regulations governing the development of land no less frequently than it reviews the Comprehensive Plan.
