R-C Residential-Commercial District

§27-801 Purpose of District.

The purpose of the R-C Residential-Commercial District is to:

A.    Provide for the orderly development of commercial uses while protecting, preserving and providing for the orderly development of medium-high residential areas.

B.    Provide for commercial uses as permitted, conditional or special exception uses, thus ensuring their proper location and development while protecting neighboring residential uses.

C.    Exclude those uses not compatible with such development.

§27-802 Permitted Uses.

Permitted uses in the R-C Residential-Commercial District are as follows:

A.    Dwellings, single-family.

B.    Dwellings, two-family.

C.    Private swimming pools.

D.    Accessory buildings and uses customarily incidental to the uses in paragraphs .A, .B and .C.

E.    Appropriate public uses and essential services.

F.    Retail establishments for the sale of dry goods, drugs, food, jewelry, variety and general merchandise.

G.    Retail establishment for the sale of hardware, household furnishings and supplies, instruments, electronic appliances, including repair service and job printing.

H.    Restaurant, tearoom, cafe, confectionery or other place serving food or beverage.

I.    Personal service shop, including barber, beauty salon, shoe repair, tailor, pickup station for laundry and dry cleaning.

J.    Automatic self-service laundry and dry cleaning.

K.    Schools for music, dance, business, child care, etc.

L.    Research and development industries.

M.    Nursing homes, sanatoriums and hospitals.

N.    Clubs or lodges.

O.    Business or professional offices for the administrative, executive and professional activities of businesses, such as financial institutions, morticians, sale of real estate.

P.    Business office buildings to be used only for the administrative functions of companies, corporations, social organizations and law offices or accountants, architects, brokers, engineers, lawyers and similar professions.

Q.    Conversions to any permitted use, provided that all regulations pertaining to conversions are met. See §27-1317.

§27-803 Special Exception Uses.

Special exception uses in the R-C Residential-Commercial District are as follows:

A.    Automobile court or motel.

B.    Indoor theater, bowling lanes or other similar place of indoor recreation.

C.    Sale of new or used automobiles and farm implements.

D.    Gasoline filling station, storage garage, public garage, auto repair garage or car wash.

E.    Retail establishment for the sale of plumbing and heating equipment and farm supplies.

F.    Warehouses.

G.    Boarding and lodging house, provided that not more than four rooms of a residence are used for such purposes.

H.    Home occupations.

I.    Conversions to any special exception use, provided that all regulations pertaining to conversions are met. See §27-1317.

§27-804 Conditional Uses.

Conditional uses in the R-C Residential-Commercial District are as follows:

A.    Townhouses.

B.    Garden apartments.

C.    Elevator apartments.

D.    Churches and public schools.

E.    Conversions to any conditional use provided that all regulations pertaining to conversions are met. See §27-1317.

§27-805 Height Regulations.

The height of all buildings shall not be greater than 40 feet, with the exception of elevator apartments, which shall not be greater than 60 feet.

§27-806 Area and Bulk Regulations.

Area and bulk regulations in the R-C Residential Commercial District are as follows, except that for all the following uses the minimum front yard setback shall be 20 feet: [Ord. 648]

A.    Dwellings, single-family–single-family dwellings shall conform to the regulations in §27-606.

B.    Dwellings, two-family–two-family dwellings shall conform to the regulations in §27-606.

C.    Dwellings, multi-family–multi-family dwellings shall conform to the regulations in §27-606, 27-607, 27-701, 27-1316 and §27-1401.

D.    Professional or business offices–professional or business offices shall conform to the regulations of §27-606 and 27-1401.

E.    Commercial uses–commercial uses shall conform to the regulations in §§27-905, 27-906, 27-907, 27-908, 27-909, 27-910, 27-911 and 27-912.

F.    Semipublic uses–semipublic uses shall conform to the regulations in §27-705.1 for new construction and §27-705.4.B for conversions.
