Outdoor Burning
§7-101 Prohibited Burning.
No person shall make, maintain, cause or permit the burning of garbage, rubbish, refuse, solid waste, construction waste or any material that causes foul, nauseous or irritating smoke and/or fumes.

§7-102 Burning Paper.
The burning of paper and paper products shall be permitted under the following conditions:
A. The fire shall be contained in a noncombustible, properly ventilated container covered with a wire screen, mesh or other suitable noncombustible cover so as to prevent pieces or particles from escaping, floating and/or being blown away.
B. No fire shall be started before 8:00 a.m. and all fires shall be out or extinguished by 7:00 p.m.
C. Paper burners/burning containers shall be at least 5 feet from any property line and 10 feet from any structure, shall be in the rear yard of any residence and shall not be located so as to cause a nuisance to any adjoining property.

§7-103 Burning for the Disposal of Wood and Brush.
The burning of wood and brush shall be permitted under the following conditions:
A. Wood and brush collected or produced on private property may be burned on the property on which it was collected or produced. Wood and brush may not be brought in from another property or location to be disposed of by burning.
B. Burning under this Section shall be commenced early enough in the day so that no flame will exist or be visible after dark. Any and all flames shall be doused with water and extinguished before dark.
C. Any fire under this section shall be attended by an individual18 years or older while flames are present and visible.
D. No fire under this section shall be started or continued when the wind conditions present an unreasonable risk of spreading the fire.

§7-104 Cooking Fires.
Charcoal, wood or similar fires for the purpose of cooking or preparing food shall be permitted so long as the fire is contained in a fireplace or cooking/grilling unit manufactured or constructed for the purpose of cooking or preparing food.

§7-105 Campfires.
Small wood fires for family or social gatherings shall be permitted under the following conditions:
A. The propellant for any fire under this Section shall be wood cut in lengths of less than 4 feet.
B. Any fire under this Section shall be on private property.
C. Any fire under this section shall be attended by an individual 18 years or older.
D. No fire under this Section shall have a base greater than 4 feet in diameter.
E. Any fire under this Section shall be doused with water and extinguished prior to the fire being left unattended.

§7-106 Bonfires and Other Fires.
Bonfires and other fires for public celebrations, fire company drills, land clearance or other purposes not specifically permitted in this Part are prohibited without the prior issuance of a permit in writing from the Township. Permits for fires under this Section must be requested in writing at least 30 days in advance and must specify the nature of the fire/event, the proposed date of the fire/burning, the individual(s) who will be in charge of the burning/fire and be signed by the owner or authorized agent of the property on which the fire/burning is to take place. The Township Supervisors may designate a Township or Fire Company official to evaluate and issue permits for fires/burning under this Section.

§7-107 Penalty.
Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
