Tenant Registration

§11-101 Short Title.

This Chapter shall be known and cited as the “Wolf Township Tenant Registration Ordinance.”

§11-102 Purpose.

The Township of Wolf recognizes the need for registration of residential units within the Township in order to insure appropriate identification of various residents of the Township for taxation purposes. The Township recognizes that the most efficient system to provide for rental occupants registration is to require the landlord to file periodic notices with the Township identifying its residential lessees.

§11-103 Definitions.

Landlord - an individual or entity owning, controlling, leasing, operating or managing the dwelling or the executor, administrator, trustee or guardian of the estate of a person holding legal title or any person selling under an article of agreement unless such article of agreement has been properly recorded in the office of the Recorder of Deeds of Lycoming County.

Lease - any permissive occupancy by a person, other than members of the landlord's immediate family, of any dwelling or dwelling unit, regardless of whether or not any charge, fee or consideration is made or levied.

Dwelling Unit - any room or group of rooms located within a building or structure and forming a single habitable unit including mobile homes, recreational vehicles and trailers, which have facilities that are intended or designed to be occupied or leased for occupation as individual homes or residences.

Person - natural persons, co-partnerships, associations, private and public corporations, authorities, fiduciaries, municipalities and any State or Federal agency.

§11-104 Registration Requirement.

No landlord shall hereafter allow to be occupied or leased to another person for occupancy any dwelling unit within the Township of Wolf unless such landlord notifies the Township within 30 days after the initiation of said occupancy and within 60 days of the enactment of this ordinance of the following information:

A.    Name, address, and telephone number of the property owner.

B.    Name, address and telephone number of the designated local property manager, if any, if the property owner does not reside in Wolf Township.

C.    The address of the dwelling unit.

D.    The name, address and number of occupants (over the age of 18 years) of each dwelling unit.

Such information shall be filed with the Township on forms to be supplied by the Township.

§11-105 Supplemental Information.

All landlords shall, within 30 days of any change of status with regard to any notification required by this Chapter, notify the Township of the specifics of that change on forms to be provided by the Township.

§11-106 Violations.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.

§11-107 Fees.

No fee shall be charged for this registration.
