Mandatory Connections

§26-101 Short Title.

This Part shall be known as and may be cited as the "Water System Regulation Ordinance of Wolf Township."

§26-102 Definitions.

Authority - the Hughesville Borough Authority.

Borough - the Borough of Hughesville.

Connection - a connection or connections between an improved property and the water main.

Improved Property - any property within Wolf Township upon which a structure is placed or erected which includes or contains or which is required by law to include or contain a system to provide water for human consumption or water for commercial or industrial uses. [Ord. 2015-01]

Private Well or Private Water Well - a water well not owned by the Authority, the Borough or the Township.

Township - refers to Wolf Township.

Water Main - means and refers to a distribution line owned or operated by the Hughesville Borough Authority.

Water System - means the Authority's wells, pumping stations, reservoirs, treatment equipment, distribution lines and related equipment.

Well - an excavation or opening into the ground made by digging, boring, drilling, driving or other methods for the purpose of providing a water supply.

§26-103 Water Connections Required.

1.    All owners of improved properties whose principal building is located within 150 feet of the water system’s water main or water main then being constructed shall make a connection to the water main for the purpose of conducting water to such property. Except as set forth in subsection .3 of this Section, any such property owner shall be given at least 90 days written notice of the requirement to connect the property to the water system. 2.    If, after the expiration of the time allotted in the notice to connect as provided in subsection .1 of this Section, any owner of any improved property shall have failed to connect to the water system, the Authority may petition the Court of Common Pleas for an injunction ordering the owner to connect and for an order making the owner responsible for the costs, expenses and legal fees incurred in the action and for all applicable fees and charges of the Authority beginning on the day after the date of expiration of the notice to connect. In addition, the Authority or its agents, may, after expiration of the notice to connect or at any time thereafter, enter upon such property and make such connection, and in such case, the Authority shall, upon completion of the work, collect the costs of connection by action in assumpsit or the Authority may file a municipal lien for the cost of connection, the same to be subject in all respects to the general laws providing for filing and recovery of municipal liens. 3.    No owner of an improved property which property is improved as of the effective date of this Chapter shall be required to connect to the water system until the expiration of 2 years from the effective date of this Chapter.

§26-104 Private Wells.

1.    Except as set forth in subsection .2 of this Section, no private water well shall be drilled on any property which is connected to the Authority water system or whose owner is required to connect pursuant to §26-103 of this Chapter.

2.    No private well in existence prior to the connection of the property to the Authority's water system shall be interconnected with the public water supply system of the Authority nor shall the well be connected to the plumbing located on the improved property which plumbing is connected to the Authority's water supply system.

§26-105 Rates and Charges.

The owner and tenant of an improved property shall be responsible for all user fees, connection fees, tapping fees and other fees in accordance with the rules and regulations of the Authority. The failure to pay said fee shall constitute a violation of this Chapter.

§26-106 Rules and Regulations.

The owners, tenants and occupiers of any improved property connected to the water system shall abide by all rules and regulations of the Authority.

§26-107 Transfer of Ownership.

The Township of Wolf hereby transfers ownership of the water main constructed pursuant to the terms and conditions of the Agreement for Extension of Municipal Water Line approved and executed by the Wolf Township Supervisors on the 5th day of April, 1999.

§26-108 Violations and Penalties.

1.    Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense. [Ord. 2004-1]

2.    Any person who shall violate a provision of this Chapter or who shall fail to comply with any of the requirements thereof or who shall exceed the authorization of any permit granted by the Authority or who shall fail to make any payment required by this Chapter or who shall violate rules and regulations of the Authority shall be subject to the termination of water service by the Authority or an action in equity, or both.
