2.55.010 Created.

A cemetery advisory board for Eagle Mountain City is hereby created and comprised of five members appointed in accordance with Chapter 2.27 EMMC. Board members shall hold no elected office in the city nor be an agent or employee of development applicants in the city, and must be residents of Eagle Mountain City. [Ord. O-05-2021 § 2 (Exh. 2.55.020 Terms.

The members appointed to the cemetery advisory board shall serve for terms of four years. The initial term of each member shall be designated by the mayor to stagger the terms of office to provide one two-year first term, two three-year terms, and two four-year terms. [Ord. O-33-2008 § 2].

2.55.030 Duties.

Members of the cemetery advisory board are authorized to consider, investigate and report to the city council on all aspects of cemetery issues as may relate to a future cemetery in Eagle Mountain, and make recommendations to the city council for the planning of a city cemetery in accordance with the general plan. The board may also establish contact with state and federal authorities to provide funding, expertise or other assistance for cemetery facility planning, operation, construction, construction and development, but may not conduct any negotiations on behalf of the city. 2.55.040 Chairperson.

The cemetery advisory board will select annually a chairperson from among its members by majority vote. The chairperson will be responsible for arranging convenient times and places for meetings of the board, providing notice of such meetings to all members. The board may, in its discretion, schedule public hearings for the purpose of receiving comments and information regarding cemetery-related issues. Public hearings will be advertised to the community by posting at the City Hall and by notice in a paper of general circulation not less than 14 days in advance of public hearing. [Ord. 2.55.050 Vacancies – Removal.

Vacancies occurring other than by expiration of term shall be filled by appointment by the mayor, with the consent of the city council, for the unexpired term and shall be filled in the same manner as original appointments. A member may be removed with or without cause by the mayor with the consent of the city council. [Ord. O-33-2008 § 5].

2.55.060 Reimbursement.

The members of the board shall serve without pay but may be reimbursed by the city for reasonable expenses incurred in performing their duties at the sole discretion of the mayor and city council. [Ord. O-33-2008 § 6].

2.55.070 Recommendation for member removal.

The board may recommend removal of a member to the city council by a majority vote of the board, for any reason, including:

A. Failure to attend more than 25 percent of the board’s scheduled meetings during any 12-month period without having been excused in advance from attendance at board meetings by the chair of the board.

B. A member’s office automatically becomes vacant if the member establishes residence outside of the city, or lives outside of city boundaries for a continuous period of more than 60 days. [Ord. O-33-2008 § 7].

2.55.080 Records – Annual report.

The board shall keep records of meetings and activities and shall make an annual report which shall be printed in the annual municipal report and/or other public forum acceptable to the mayor and city council. [Ord. O-33-2008 § 8].
