8.20.010 Fireworks time and date restrictions.

In accordance with Section 53-7-225, Utah Code Annotated 1953, the discharge of Class C common state-approved explosives (fireworks) is prohibited at all times except the following:

A. Between the hours of 11:00 a.m. and 11:00 p.m., except that on July 4th and July 24th, the hours are 11:00 a.m. to midnight:

1. Beginning on July 2nd and ending on July 5th; and

2. Beginning on July 22nd and ending on July 25th.

B. Beginning at 11:00 a.m. on December 31st and ending at 1:00 a.m. on the following day or, if New Year’s Eve is on a Sunday, then at the same times on that prior Saturday; and

C. Beginning at 11:00 a.m. on Chinese New Year’s Eve and ending at 1:00 a.m. on the following day. [Ord. O-18-2022 § 2 (Exh. A)].

8.20.020 Additional restrictions.

In accordance with Section 53-7-225, Utah Code Annotated 1953, the city council may by resolution designate certain areas within the city where fireworks are prohibited or impose other restrictions on the discharge of fireworks. [Ord. O-18-2022 § 2 (Exh. A)].

8.20.030 Penalty for violation.

A person is guilty of an infraction, punishable by a fine of up to $1,000, if the person discharges fireworks outside the legal discharge dates and times or in an area where fireworks are prohibited. [Ord. O-18-2022 § 2 (Exh. A)].

8.20.040 Civil liability.

A. An individual who negligently, recklessly, or intentionally causes or spreads a fire through discharge of a Class C explosive is liable for the cost of suppressing that fire and any damages the fire causes.

B. If the individual described in subsection A of this section is a minor, the parent or legal guardian having legal custody of the minor is liable for the costs and damages for which the minor is liable under this section.

C. Discharging a Class C explosive in an area in which fireworks are prohibited or in violation of other restrictions adopted in accordance with EMMC 8.20.030 constitutes the negligent, reckless, or intentional conduct described in subsection A of this section. [Ord. O-18-2022 § 2 (Exh. A)].
