8.30.010 Intent.

It is the intent of the city council of Eagle Mountain City to require, under the terms of this chapter, that all streets and roads which are privately owned and not open to access by the public shall be accessible by public safety, fire and medical personnel for the purpose of responding to calls for fire suppression and medical needs assistance, investigating violations of law, suspected violations of law, and pursuing and apprehending offenders where there is probable cause to believe such offenders are or may be a danger to themselves or others. 8.30.020 Approval of gate mechanism.

Whenever a gate is erected or placed to regulate traffic along or to a private road or to a secondary access to a public road system, the owner or operator of the gate shall first obtain approval of the gate locking and opening mechanism from the Eagle Mountain City fire chief to assure that the opening mechanism can be operated and unlocked by public safety, medical or sheriff’s personnel in the conduct of their official duties. Each locking mechanism installed in such gates shall be of a design and type approved by the fire chief of Eagle Mountain City and the fire chief shall be supplied with the information, keys, or other electronic mechanism necessary to operate or unlock the privately maintained gates. 8.30.030 Unapproved gate mechanisms unlawful.

It is unlawful to operate, own, or maintain a private gate across a road used by or intended to be used by public safety personnel, fire department apparatus or personnel, or medical first responders without first having obtained the written approval of the gate locking mechanism from the Eagle Mountain City fire chief.
