OFFICERS AND EMPLOYEES

1-6-3:    COMPENSATION; SALARIES

1-6-1 APPOINTIVE OFFICERS:

A.    Appointment Of Officers: On or before the first Monday in February following a municipal election, the mayor, with the advice and consent of the city council, shall appoint a qualified person to each of the offices of city recorder and city treasurer.

B.    Recorder As Ex Officio City Auditor: The city recorder shall be ex officio the city auditor and shall perform the duties of such office.

C.    Additional Appointments; Filling Vacancies: The mayor, by and with the advice and consent of the council, may also appoint all such officers and agents as may be provided by law or ordinance, and in like manner fill all vacancies among the same, except as otherwise provided by law or ordinance.

D.    Vacating Office: If any appointive officer shall, at any time during the period for which such office is held, move from the limits of the city, such office shall there by become vacant, excepting, however, the offices of city attorney and city engineer. (1957 Code § 17-19; amd. 2007 Code)

1-6-2 OATH AND BONDS OF OFFICERS:

A.    Required: Before entering upon the discharge of their duties, all elected and appointed officers of the city shall take and subscribe the oath or affirmation required by law; and file bond, with two (2) or more good and sufficient sureties, payable to the city, conditioned for the faithful performance of their duties. B.    Bond Approval: The bond of the mayor shall be approved by the city council, and the bonds of all other officers by the mayor. (1957 Code § 17-21)

C.    Amount Of Bond; Payment Of Premium:

1. The amount for which the respective officers shall give bonds, as above stated, shall be as follows:

a. Mayor and council members, five hundred dollars ($500.00) each.

b. City recorder and city treasurer, one thousand dollars ($1,000.00) each.

2. The premium charged by a corporate surety for any official bond shall be a legal charge against the funds of the city. (1957 Code § 17-22; amd. 2007 Code)

D.    Filing Of Bonds: All bonds given by the officers of the city shall be filed with the city recorder, except the bond of the city recorder, which shall be filed with the city treasurer. (1957 Code § 17-23)

1-6-3 COMPENSATION; SALARIES:

The city council shall fix by ordinance, within the limits as provided by law, the salaries of all elective and appointive officers. Such salaries and compensation shall be paid from the city treasury as fixed by ordinance of the city council. (1957 Code § 17-84; amd. 2007 Code)
