5-4-1:    CURFEW REGULATIONS

5-4-1 CURFEW REGULATIONS:

A.    Age And Hour Restrictions; Exception:

1. No person under the age of eighteen (18) years shall be present or remain upon any of the streets, alleys or public places or vacant lots in the evenings between the hours of eleven o'clock (11:00) P.M. and five o'clock (5:00) A.M. on Sunday, Monday, Tuesday, Wednesday and Thursday, and between the hours of twelve o'clock (12:00) midnight and five o'clock (5:00) A.M. on Friday and Saturday.

2. Exceptions will be made when minors are accompanied by a parent, guardian or other person having legal custody of such minor, or when the employment or lawful business of such minor makes it necessary to be on the streets, alleys or public places during such hours.

3. On any night when school, civic or church functions are taking place, the hours of curfew shall be set at twelve o'clock (12:00) midnight to five o'clock (5:00) A.M. in order to provide adequate time to attend such functions provided for minors.

4. When a permit is required from the city office under this section, such permit shall be kept upon the person, and it shall be unlawful for minor to be on the streets, alleys or public places during such curfew hours without such permit.

B.    Parental Responsibility: No person, guardian or other person having legal charge or custody of any person under eighteen (18) years of age shall knowingly allow or permit any such person or child, ward or other person under such age, while in such legal custody, to go or be in or upon any of the streets, alleys, or public places when such going or being in or upon such streets, alleys or public places would be a violation by such minor person of any provision of subsection A of this section. C.    Penalty: Any violation of this section shall be a class B misdemeanor and, upon conviction thereof, subject to penalty as provided in section 1-4-1 of this code. (Ord. 1- 1998, 12-17-1998; amd. 2007 Code)
