LIVESTOCK WITHIN CITY LIMITS

5-7-3:    FAILURE TO CLOSE ENTRANCE TO ENCLOSURE

5-7-1 OWNER LIABLE FOR TRESPASS OF ANIMALS:

The owner of any livestock including cattle, horse, ass, mule, sheep, goat or swine that trespasses upon the premises of another person is liable in a civil action to the owner or occupant of the premises for any damage inflicted by the trespass. A city representative may intervene to remove the animal and the city is entitled fair compensation for costs incurred. lf the animal is not claimed within ten (IO) days after written notification is sent to its owner, a city representative may sell the animal to cover costs incurred.

5-7-2 ANIMALS RUNNING AT LARGE:

No person who owns or is in possession of livestock shall permit it to run at large within the city limits of Huntington.

Violators are guilty of a class C misdemeanor.

5-7-3 FAILURE TO CLOSE ENTRANCE TO ENCLOSURE:

A person who willfully throws down a fence or opens bars or gates into any enclosure other than the person's own enclosure or into any enclosure jointly owned or occupied by such person and others, and leaves it open is guilty of a class C misdemeanor, and is liable for any damage or any injury sustained by any person as a result of such an act.
