7-5-1: CASTLE VALLEY SPECIAL SERVICE DISTRICT:

Water, sewer, drainage and road services for the city shall be provided in accordance with a resolution approving the inter local governmental agreement between the city and Castle Valley special service district. (Res. 11-2003, 7-23-2003)

7-5-2: OUTSIDE-BOUNDARY WATER & SEWER CONNECTION:

1.    The City may allow, grant, issue, or provide new culinary water or sewer connections for use on or for the benefit of properties located outside the current City boundaries, subject to the final approval of the Castle Valley Special Service District and the policies, application process, conditions, and costs/fees established by the District and/or the City.

2.    This ordinance shall not prohibit the City from running and connecting to any and all necessary transmission lines in regard to its respective water and sewer systems for the transport and flow of water and sewer to and from source and treatment facilities.

Also, this ordinance shall not prohibit the City from making any outside-boundary connections determined by the City to be necessary for the immediate safety and health of City residents and/or in light of exigent or emergency situations.

3.    It shall be unlawful for any person or entity to install an outside-boundary connection in violation of this ordinance. Violators of this ordinance shall be guilty of a Class B Misdemeanor. Violators shall be responsible for any and all costs and expenses associated with such unlawful acts or prohibitions, including, but not limited to excavation, restoration, and restitution. In addition to said criminal penalty, the City may terminate culinary water and/or sewer system service to any property whereon the owner and/or occupant, or any agent thereof, violates this ordinance, or fails to pay applicable fees in relation thereto, or for fines imposed for violating this ordinance. 7-5-3: WATER AND SEWER MONTHLY SERVICE AND CONNECTION FEES:

A.    Established: The city council shall from time to time by resolution adjust fees at which shall be charged for the various services to be provided.

B.    Culinary usage rates: The city council shall establish by resolution the fees at which shall be charged. Overage fees will be charged per 1,000 gallons.

F.    Trailer courts: Monthly service fees for water used in trailer courts shall be charged a fee established by resolution of the city council. The monthly rate is per occupied unit. Any overcharges will be charged at the residential rate after computing how many gallons are applied to the occupied units. The trailer court owners will be required to inform the city monthly of how many units are occupied so they may be billed accordingly. If the city determines that there are more occupied units than reported by the trailer park owners/managers, all unreported occupied units will be charged retroactive back three months for water, sewer and garbage (if applicable). Overage fees will be charged per 1,000 gallons.

G.    Monthly water and sewer service fees for multiple living complexes, apartments, premise occupations and in-home businesses: Monthly service fees for water and sewer used in multiple dwellings and apartments shall be the same as single residential rates for each family living unit or apartment. Overage fees will be charged per 1,000 gallons.

1. Premises occupations that require water will be charged the commercial water and sewer rates.

2. In-home businesses that require water will be charged the commercial water and sewer rates instead of residential rates.

H.    Beginning January 1, 2014 an annual 2% increase will be added to all culinary water services. (Ord. 6-2012)

I.    Monthly sewer rates: The city council shall from time to time by resolution adjust fees at which shall be charged for the various services to be provided.

J.    Beginning January 1, 2014 an annual 2% increase will be added to all sewer services.

K.    Sewer connection fee amount is established by resolution of the city council. This fee shall be due and payable by any patron whose residence, is situated within 300 feet of a working sewer line, whether such patron is connected to the sewer or not. Patrons living outside the city limits, eligible for connection and living within 300 feet of a working sewer line must pay a connection fee established by resolution of the city council.

L.    Culinary water connection fee and water shares: Water shares from Huntington Cleveland Irrigation Company will only be accepted. Utility billing must remain in property owner's name.

1. 3/4" meter water connection fee: Fee is established by resolution of the city council plus three (3) shares of stock in said water company or to allow the applicant to pay the per share rate set by Huntington City Ordinance 3-2012 for the three (3) shares of water.

2. 1" meter water connection fee: Fee is established by resolution of the city council plus six (6) shares of stock in said water company or to allow the applicant to pay the per share rate set by Huntington City Ordinance 3-2012 for the six (6) shares of water.

3. 1.5" meter water connection fee: Fee is established by resolution of the city council plus twelve (12) shares of stock in said water company or to allow the applicant to pay the per share rate set by Huntington City Ordinance 3-2012 for the twelve (12) shares of water.

4. 2" meter water connection fee: Fee is established by resolution of the city council plus twenty four (24) shares of stock in said water company or to allow the applicant to pay the per share rate set by Huntington City Ordinance 3-2012 for the twenty four (24) shares of water.

M.    Water connection fee for trailer courts: Fee is established by resolution of the city council. Each court must furnish the City with the fee for each meter hookup plus furnish three (3) shares of stock in said water company for each trailer space or to allow the applicant to pay the connection fee plus the per share rate set by Huntington City Ordinance 3-2012 for the three (3) shares of water for each trailer space. Utility billing must remain in property owner's name. Special approval must be obtained from the City Council before 1" connections, 1 1/2" connections or 2" connections are installed.

N.    Water connection fee for duplexes and fourplexes: Fee is established by resolution of the city council. Each living unit requires a connection fee plus three (3) shares of stock in said water company or to allow the applicant to pay the connection fee plus the per share rate set by Huntington City Ordinance 3-2012 for the three (3) shares of water. Utility billing must remain in property owner's name. Special approval must be obtained from the City Council before 1" connections, 1 1/2" connections or 2" connections are installed.

O.    Water connection fee for apartment houses and business houses: Fee is established by resolution of the city council. Each building unit requires a connection fee plus three (3) shares of stock in said water company for each individual living or business space within the unit or to allow the applicant to pay the connection fee plus the per share rate set by Huntington City Ordinance 3-2012 for the required shares of water per living or business space. Utility billing must remain in property owner's name. Special approval must be obtained from the City Council before 1" connections, 1 1/2" connections or 2" connections are installed.

P.    Out of town water connection fees: *Any person desiring an outside culinary water and/or sewer connection must complete the application prepared by Castle Valley Special Service District and receive initial approval from the City whose System they will connect to. Fee is established by resolution of the city council. 3/4" water connection: connection fee plus three (3) shares of stock in said water company or to allow the applicant to pay the connection fee plus the per share rate set by Huntington City Ordinance 3-2012 for the three (3) shares of water; a 1" water connection: connection fee plus six (6) shares of stock in said water company or to allow the applicant to pay the connection fee plus the per share rate set by Huntington City Ordinance 3-2012 for the six (6) shares of water; a 1 1/2" water connection: connection fee plus twelve (12) shares of stock in said water company or to allow the applicant to pay the connection fee plus the per share rate set by Huntington City Ordinance 3-2012 for the twelve (12) shares of water; a 2" water connection: connection fee plus twenty-four (24) shares of stock in said water company or to allow the applicant to pay the connection fee plus the per share rate set by Huntington City Ordinance 3-2012 for the twenty-four (24) shares of water. *Quoted from the new agreement.

Q.    Secondary water connection fees: Fee is established by resolution of the city council.

R.    Late, shut off & reconnect fees:

1. Culinary Water:

a. Due date is the 15th of each month, outstanding balances are subject late fee. The fee is established by resolution of the city council.

b. Customers that have their water shutoff for non-payment will be charged a fee to reinstate water service plus the outstanding account balance. The fee is established by resolution of the city council.

c. Customers that have their water meter removed for non-payment will be charged a fee to reconnect the meter plus the outstanding account balance. The fee is established by resolution of the city council.

d. Culinary connection will be considered abandoned after 1 year of non- payment and the water shares forfeited to Huntington City. To reconnect, the outstanding account balance has to be paid plus a reconnection fee and 3 water shares, or the equivalent in cash set by Huntington City Ordinance 3-2012. The reconnection fee is established by resolution of the city council.

2. Secondary Water:

a. Secondary water is billed annually on the March statement; the annual fee is set by resolution of the city council. Secondary is subject to the same penalties as culinary except abandonment. (Ord. 2-2013)

b. Secondary connection will be considered abandoned after 6 months of nonpayment. To reconnect the outstanding account balance has to be paid plus a reconnection fee. If there is no culinary connection on that site 3 water shares will be required or the equivalent in cash set by Huntington City Ordinance 3-2012.

c. Secondary non-use fee: The annual fee is set by resolution of the city council.

7-5-4: EFFICIENT SPRINKLER IRRIGATION PRACTICES:

All users of water service shall be required to keep their sprinklers, faucets, valves, hoses and all apparatus connected to the water system in good condition at their own expense and all waterways closed when not in use. Watering with an open hose and allowing sprinklers to spray so that water is running down the curb or a neighboring property is prohibited.

Sprinkler irrigation of all lawns and landscapes is prohibited between the hours of ten o'clock (10:00) A.M. and six o'clock (6:00) P.M.

The provisions of this section shall apply to all landscapes within the city. This section does not apply in the following situations:

A.    New lawns that require frequent irrigation for establishment purposes within ninety (90) days of planting.

B.    Short cycles required for testing, inspecting and maintaining irrigation systems.

C.    Other situations as permitted by the city.

Penalty For Noncompliance: A maximum of three (3) warnings can be issued to the wasteful user at which time the city council may consider discontinuing the water service. If the city council elects to consider the matter of discontinuance, it shall give notice to the water user of the intention to discontinue his or her water service. The notice shall inform the user of the time and place of the meeting and of the charges that led to the consideration of discontinuance. Said water user shall have opportunity to appear with or without legal counsel and present his or her reasons why the water service should not be discontinued. Upon hearing, the city council shall notify said user in writing of its determination and if the determination is to discontinue the user's water service, it shall notify said user of the period during which the service will remain discontinued.
