10.05.010 Adoption of Utah Traffic Code.

The Utah Traffic Code, Rules of the Road 1967, as amended by the 1969 supplement, compiled by the Department of Public Safety of the State of Utah, prepared and published in book form by said agency, is hereby approved and adopted as the traffic code of the town of Manila, except as hereinafter specified, and by this reference is made a part of this chapter to the same extent and effect as though said code were copied herein in full.

A.    All reference in said code to the State Road Commission shall be deemed to mean the “town of Manila” and its departments, agencies, or agents, unless the context otherwise requires.

B.    All reference to “local authorities” shall be deemed to mean the town board of trustees of Manila Town.

C.    All reference in said code to the “Department of Public Safety of the State of Utah” shall be deemed to mean the town marshal, unless the context otherwise requires.

D.    All reference in said code to “magistrate” shall mean the justice of the peace, unless the context otherwise requires. [Ord. 6-4-70 § 1; Ord. 12-5-68 § 1.]

10.05.020 Prima facie speed – Designated streets.

When appropriate street signs giving notice of speeds thereon are erected, the prima facie speed limits designated in MMC 10.05.100(A) shall apply to the appropriate streets listed therein. [Ord. 12-5-68 § 2.]

10.05.030 Angle parking.

Angle parking shall be permitted upon the streets or parts of streets described in MMC 10.05.100(B). The marshal shall mark or sign such streets or parts of streets and also indicate the angle of such parking. [Ord. 12-5-68 § 3.]

10.05.040 Through streets designated.

Those streets and parts of streets described in MMC 10.05.100(C) are hereby declared to be through streets. [Ord. 12-5-68 § 4.]

10.05.050 Authority to erect stop or yield signs at through streets.

Whenever any ordinance of this town designates and describes a through street it shall be the duty of the marshal to place and maintain a stop sign, or where safety and efficiency require at any intersection a yield sign, on each and every street intersecting such through street unless traffic at any such intersection is controlled at all times by traffic-control signals; provided, however, that at the intersection of two such through streets or at the intersection of a through street and a heavy traffic street not so designated stop signs shall be erected at the approaches of either of said streets as may be determined by the marshal upon the basis of an engineering and traffic study. 10.05.060 Stop intersections.

The entrances to intersections described in MMC 10.05.100(D) are hereby declared to be stop entrances. [Ord. 12-5-68 § 6.]

10.05.070 Location of stop signs.

The town marshal shall erect and maintain a stop sign at all stop entrances to intersections. [Ord. 12-5-68 § 7.]

10.05.080 Yield intersections.

The entrances to intersections described in MMC 10.05.100(E) are hereby declared to be yield entrances. [Ord. 12-5-68 § 8.]

10.05.090 Location of yield signs.

The town marshal shall erect and maintain a yield sign at all yield entrances to intersections. [Ord. 12-5-68 § 9.]

10.05.100 Schedules.

A.    Schedule 1 – Prima Facie Speed Limits on Designated Streets.

1.    Schedule 1-a.

a.    Twenty-five miles per hour when signs are erected giving notice thereof on the following streets or parts of streets: Main Street; First West; Second, Third and Fourth West; First East; First North; Third and Fourth North.

b.    Twenty miles per hour on Second North from intersection at Third West to First East; yield sign at intersection of First East and Second North.

2.    Schedule 1-b. Forty miles per hour when signs are erected giving notice thereof on the following streets or parts of streets: (Reserved).

B.    Schedule 2 – Angle Parking.

1.    Schedule 2-a. Forty-five-degree angle parking shall be permitted on the following streets or parts of streets: angle parking on Second North in front of post office; no parking in front of school within the signs between 8:00 a.m. and 4:30 p.m.

2.    Schedule 2-b. Thirty-degree angle parking shall be permitted on the following streets: (Reserved).

C.    Schedule 3 – Through Streets Designated. The following streets are designated through streets: (Reserved).

D.    Schedule 4 – Stop Intersections. When signs are erected giving notice thereof, the following intersections shall constitute stop intersections: (Reserved).

E.    Schedule 5 – Yield Intersections. When signs are erected giving notice thereof, the following intersections shall be yield intersections: (Reserved). [Ord. 12-5-68 § 10.]

10.05.110 Penalties.

Any person violating, causing or permitting violation of any provision of this chapter shall be guilty of a misdemeanor. Notwithstanding other language or provisions in the Utah Traffic Code, Rules of the Road 1967, hereby adopted, any violator of this chapter, upon conviction, shall be punished by a fine of not more than $299.00, or by a jail sentence not to exceed six months, or by both such fine and jail sentence. 10.05.120 Filing.

Three copies of the Utah Traffic Code, Rules of the Road 1967, as amended by the 1969 supplement, hereby adopted by reference, shall be filed for use and examination in the office of the town clerk. [Ord. 6-4-70 § 2; Ord. 12-5-68 § 13.]
