2-7-101 Appointment and Term.

The Mayor shall, on or before the first Monday in February, 1980, appoint a Justice Court Judge for a term of four (4) years beginning the first Monday in February, 1992. The Judge now holding office or appointed to fill any vacancy shall hold office until the successor is duly appointed and qualified. His appointment shall be made by the Mayor, with the advice and consent of the City Council, and he shall have all of the qualifications which are required of a Justice Court Judge as set forth in Title 78, Chapter 5, Utah Code Annotated 1953, as amended.

2-7-102 Powers and Duties.

The Justice Court Judge shall hold a Justice Court for the City and shall have and exercise all those powers and perform all those duties which are granted to Justice Courts by the laws of the state of Utah and ordinances of the City.

2-7-103 Jurisdiction.

The Justice Court shall have exclusive original jurisdiction of cases arising under, or by reason of, the violation of any provision of this Code or any other ordinance of the City and shall have the same powers and jurisdiction as Justice Court in all other actions, civil and criminal.

2-7-104 Waiver of Jury Trial.

In any civil or criminal action before the Justice Court, a trial by jury is waived, unless a jury is demanded by one of the parties.

2-7-105 Records and Reports.

The Justice Court shall keep a book denominated as a docket in which it shall enter a record of all proceedings in the court. The Justice Court Judge shall report to the City Council, at such times as the Council shall direct, the number of cases brought before him on behalf of the City, together with the amount of fines levied, the amount collected, and such other pertinent facts as may be required by the Council. The Justice Court shall on or before the last day of each month, pay to the City Treasurer all monies received by it for fines or otherwise belonging to the City, taking therefor the Treasurer’s receipts, which the Judge or clerk shall file with the City Recorder.

2-7-106 Disqualification or Absence.

In case the Justice Court Judge, for any reason, shall be absent, the Mayor shall appoint some other Justice Court Judge or Circuit Judge residing within the county, to act as municipal Justice Court Judge Pro Tem, and he shall have the powers and shall discharge the duties of the municipal Justice Court Judge and in the same manner and to the same extent as the municipal Justice Court Judge might have done, but during the existence of such disability or absence only.

2-7-107 Court Location.

The Justice Court Judge shall hold court within the limits of the City at such place as may be designated by a resolution of the City Council.

2-7-108 Laws and Ordinances.

The City Council shall provide and keep current for the Justice Court Judge copies of the motor vehicle laws of Utah, handbook for Justice Court Judges as approved by the Utah Supreme Court, all state laws affecting municipalities, and this City Code.

2-7-109 Attendance at Institute.

The Justice Court Judge shall attend such training as required by state law for certification of the Judge and Justice Court. Upon failure to attend such training, the Justice Court Judge shall vacate his office, unless he has obtained a written excuse for good cause from the appropriate state official. The Justice Court Judge shall be reimbursed by the City for costs incurred while attending such training.

2-7-110 Compensation.

The Justice Court Judge shall be paid a fixed monthly salary determined in accordance with Utah Code Annotated 1953, 78-5-128 and 78-5-129, as amended, as fixed from time to time by ordinance. The compensation paid to the Justice Court Judge at the time of the effective date of this section shall remain unchanged until altered by ordinance. The City Council shall annually review and may adjust such compensation.
