OFFENSES AGAINST PROPERTY

8-5-101 Obstruction of Flood Channel.

It shall be unlawful for any person to do any of the following acts:

(1)    To place in any manner or by any means any garbage, trash, or waste matter of any nature or any kind into the channel of Hobble Creek, in any other existing drainage channel, ditch, waterway, watercourse, pipe, or other conveyance of wastewater, storm water or irrigation water within the City.

(2)    To alter the channel of Hobble Creek, in any other existing drainage channel, ditch, waterway, watercourse, pipe, or other conveyance of wastewater, storm water or irrigation water within the City by any excavation or by placing or constructing any fill, rip-rap, retaining wall or similar structure, wall, footing, foundation, piling, weir, dam, bridge, or pipe therein, unless such person has first:

(a)    complied with Section 11-3-547 if compliance with that section is required; and

(b)    received a written permit from the Public Works Director for any such excavation, work, or installation.

8-5-102 Injury to Trees or Shrubs.

It shall be unlawful for any person to injure any tree or shrub growing on any of the public streets or on any of the public property within the City by spraying, cutting, girdling, painting, whitewashing, or defacing in any manner; or by root cutting or exposure; or by placing oil or any injurious substance on the ground around any such tree or shrub; or by tying animals to the same; or by piling materials of any kind upon or about the same; or by attaching signs, supports wires or other devices to any such trees or shrubs.
