2.15.010 Functions and duties.

In accordance with Utah Code, the Mayor shall be the Chief Executive and Administrative Officer of the City.

(A) The Mayor shall:

(1) Enforce the laws and ordinances of the City;

(2) Ensure that all applicable statutes and municipal ordinances and resolutions are faithfully executed and observed;

(3) Attend all meetings of the City Council;

(4) From time to time report to the Council the condition and needs of the City;

(5) Report to the Council any remitted fine or forfeiture granted under subsection (B)(2) of this section;

(6) Report to the Council any release granted under subsection (B)(3) of this section;

(7) Perform all duties prescribed by statute or municipal ordinance or resolution;

(8) Recommend for Council consideration any measure that the Mayor considers to be in the best interests of the City; and

(B) The Mayor may:

(1) Appoint and remove the City Administrator; department heads; commission, board and committee members with the advice and consent of the City Council, except as may otherwise be specifically limited by law;

(2) Remit fines and forfeitures;

(3) Release a person imprisoned for violation of a municipal ordinance;

(4) Appoint or act as the budget officer for the purpose of fulfilling the requirements of the Uniform Municipal Fiscal Procedures Act for Utah cities;

(5) Appoint, with the advice and consent of the City Council, a qualified person to each appointed office deemed necessary for good government;

(6) Execute agreements within certified budget appropriations on behalf of the City, or delegate by written executive order the power to execute such agreements to executive officials, subject to the procedure described in Utah Code; and

(7) When necessary, call on the male residents of the City over the age of 21 years to assist in enforcing the laws of the state and ordinances of the City and may exercise within the City limits the power to suppress disorder and keep the peace as allowed by statute and the Constitutions of Utah and the United States. 2.15.020 Presiding officer.

The Mayor shall be the Chief Executive Officer and preside at the meetings of the City Council. However, the Mayor shall not vote at meetings of the City Council, except in case of a tie vote of the City Council, the appointment or dismissal of the City Administrator, or as otherwise provided by law. Furthermore, the Mayor shall have no power to veto any act of the City Council unless otherwise specifically authorized by statute. [Ord. 12-20 § 1 (Exh. A); Ord. 11-03 § 1 (Exh. 2.15.030 Records open to inspection.

All records, books, papers, and documents belonging to any office of the City shall be open at any time to inspection by the Mayor except as otherwise prohibited by law. The Mayor may require any officer of the City, at any time, to prepare and provide a report in detail of all transactions in his office or any matters connected therewith. [Ord. 12-20 § 1 (Exh. 2.15.040 Mayor Pro Tempore.

The City Council shall annually elect the Mayor Pro Tempore and two additional persons, in specific order of succession, as emergency interim successors to act in the absence of the Mayor. In the absence of the Mayor or because of his inability or refusal to act, the Mayor Pro Tempore shall preside over the meeting and shall possess the powers and duties of Mayor. Any member of the City Council elected as Mayor Pro Tempore shall retain his power and authority as a member of the City Council and shall be entitled to vote as a member of the City Council on all matters. 2.15.050 Midterm vacancy in office.

A midterm vacancy in the office of the Mayor shall be filled as provided in Utah Code. [Ord. 12-20 § 1 (Exh. A); Ord. 11-03 § 1 (Exh. A); Code 1971 § 2.03.050.]

2.15.060 Restrictions.

The Mayor may not serve as the City Recorder or as the City Treasurer as dictated in Utah Code. [Ord. 12-20 § 1 (Exh. A); Ord. 11-03 § 1 (Exh. A); Code 1971 § 2.03.060.]

2.15.070 Filling office of Mayor and other elected or judicial positions.

(A) For purposes of this section, “elected position” means any office whose election or appointment is governed by the provisions of Title 20A, Utah Code Annotated 1953.

(B) No Mayor may hold his or her office and another elected position or judicial appointment, if that position or appointment includes a constituency or jurisdiction that includes any part of the Syracuse City boundaries.

(C) If a serving Mayor is sworn into a position described in subsection (B) of this section, then the Mayor’s office shall be deemed vacated from the time that the Mayor was sworn into the new position. The act of accepting the oath of office in that position is deemed a voluntary resignation and forfeiture of entitlement to continue in the office of Mayor.

(D) If a person is elected as Mayor and already holds an elected position or judicial office, then the Mayor shall vacate the prior position or office at the time of being sworn in as Mayor. If the Mayor does not vacate the prior position or office before or at the time of being sworn in as Mayor, then the Mayor will be deemed to have voluntarily resigned from the office of Mayor.
