3.15.010 Establishment.

There is hereby created a Board of Adjustment, which shall consist of five members. The members of the Board of Adjustment shall be appointed by the Mayor with the advice and consent of the City Council. The City Council may fix per diem compensation for the members of the Board of Adjustment, based on necessary and reasonable expenses and on meetings actually attended. [Ord. 11-07 § 1 (Exh. 3.15.020 Term of office.

Each member of the Board of Adjustment shall serve for a term of five years, and until his successor is appointed; provided, that the length of terms may be staggered such that the term of one member shall expire each year. One member shall be appointed in the month of July of each year. Any member may be removed for cause by the City Council. A member so removed shall be entitled to a public hearing before the City Council if requested in writing by the member being removed within five days of a Council vote. Vacancies shall be filled in the same manner as the original appointment for the unexpired term. [Ord. 11-07 § 1 (Exh. A); Code 1971 § 3.03.020.]

3.15.030 Organization.

The Board of Adjustment shall elect a Chairman and may adopt such rules for its own proceedings as are consistent with law. Meetings of the Board shall be held at the call of the Chairman and at such other times as the Board may determine. The Chairman or, in his absence, the Acting Chairman may administer oaths and compel the attendance of witnesses. All meetings of the Board shall comply with the Open and Public Meetings Act. The Board shall keep minutes of its proceedings, showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions; all of which shall be immediately filed in the office of the Board and shall be a public record. 3.15.040 Powers.

The Board of Adjustment shall have those duties, powers and authority as granted to it by the land use ordinances of the City and by law. [Ord. 11-07 § 1 (Exh. A); Code 1971 § 3.03.040.]
