7.25.010 Purpose.
This chapter authorizes the Fire Chief or designee to regulate or prohibit the use of fireworks and other ignition sources when hazardous environmental conditions necessitate such regulations or prohibitions. [Ord. 25-15 § 1; Ord. 12-27 § 1 (Exh. A); Code 1971 § 7.05.010.]
7.25.012 Definitions.
For the purpose of this chapter:
(A) The following terms are defined in Section 53-7-202, Utah Code Annotated 1953: display fireworks, fireworks, special effects.
(B) “Hazardous environmental conditions” means extremely low humidity, extremely low soil moisture, windy conditions, the presence of dry vegetation, or any combination thereof, all as determined by the Fire Chief or designee. [Ord. 25-15 § 1.]
7.25.015 Public display of display fireworks or special effects – Permit required – Tentative approval.
No person shall discharge any display fireworks or special effects without first obtaining a permit issued by the Fire Department. A separate permit shall be required for each display fireworks or special effects event. Application for a permit shall be made on the form approved by the Fire Chief and shall:
(A) Include the name, address, and telephone number of the person, firm, entity, or corporation applying for the permit;
(B) Describe the specific location of the discharge, display, fallout, and spectator locations, as per the International Fire Code;
(C) Include evidence of commercial general liability insurance in an amount not less than $1,000,000 per occurrence and $2,000,000 aggregate;
(D) Describe a plan for monitoring weather conditions, crowd control, and contingency plans for adverse or changing conditions;
(E) Include any additional information reasonably required by the City;
(F) Include a copy of the operator’s current license; and
(G) Be accompanied by payment of the required fee.
A completed application containing the above information shall be submitted to the Fire Department at least 14 days prior to the planned discharge of display fireworks or special effects.
Within three business days of receipt of a completed application, the Fire Chief or designee shall deny or tentatively approve the application and notify the applicant of the decision. [Ord. 25-15 § 1; Ord. 14-08 § 1.]
7.25.018 Public notice of fireworks events.
When the Fire Chief or designee tentatively approves a permit, the City and the applicant shall post details regarding the event on their respective websites. If the applicant does not have a website, the applicant shall post details regarding the event on one or more social media sites. [Ord. 25-15 § 1.]
7.25.020 Final inspection and final approval.
On the date of the planned discharge, the Fire Chief or designee shall: inspect the discharge, display, fallout, and spectator locations; determine whether hazardous environmental conditions exist; and grant (with or without conditions) or deny approval for the event. No person shall discharge any display fireworks or special effects without or contrary to the final approval of the Fire Chief or designee. [Ord. 25-15 § 1; Ord. 12-27 § 1 (Exh. 7.25.030 Authority of Fire Chief to recommend orders.
When the Fire Chief determines that hazardous environmental conditions necessitate controlled use of any ignition source, including fireworks, special effects, lighters, matches and smoking materials, the Fire Chief may prohibit the ignition or use of the ignition source in brush-covered areas or the wildland urban interface area. 7.25.040 Geographic areas affected.
The Fire Chief shall determine the areas subject to prohibition and the extent of the prohibition and shall identify the same in a written order. The order shall include a map of the affected areas. [Ord. 25-15 § 1; Ord. 12-27 § 1 (Exh. A); Code 1971 § 7.05.040.]
7.25.050 Public notice.
The City shall immediately post copies of the order in at least three public places within the City and post a copy of the order on the official City website. [Ord. 25-15 § 1; Ord. 12-27 § 1 (Exh. A); Code 1971 § 7.05.050.]
7.25.060 Violation – Penalty.
Any person who violates an order of the Fire Chief issued pursuant to this chapter is guilty of an offense as indicated in SMC 7.05.070. [Ord. 25-15 § 1; Ord. 12-27 § 1 (Exh. A); Code 1971 § 7.05.060.]
7.25.070 Enforcement.
Every officer charged with enforcement of state and municipal laws within the jurisdiction of this municipality, including the Fire Chief, is hereby charged with the responsibility to enforce this title. [Ord. 25-15 § 1; Ord. 12-27 § 1 (Exh. A); Code 1971 § 7.05.070.]
7.25.080 Severability.
Repealed by Ord. 25-15. [Ord. 12-27 § 1 (Exh. A); Code 1971 § 7.05.080.]
