Article I. 2008 ORDER

VIRGINIA:

IN THE CIRCUIT COURT FOR THE CITY OF STAUNTON

IN RE:

AGREEMENT OF THE CITY OF STAUNTON AND COUNTY OF AUGUSTA TO CHANGE BOUNDARY LINE

FINAL ORDER

This matter comes before the Court to be heard on consideration of entry of a final order pursuant to the provisions of Virginia Code Section 15.2-3108 regarding an agreed boundary line change between the City of Staunton and the County of Augusta.

Upon consideration of the joint petition, with exhibits, regarding the agreement to change the boundary line, the Court finds and concludes as follows:

1. The City of Staunton (City) is a municipal corporation of the Commonwealth of Virginia.

2. The County of Augusta (County) is a political subdivision of the Commonwealth of Virginia.

3. The City and County have entered into an agreement dated November 3, 2008 (Agreement) to change the boundary line between them to include within the corporate limits of the City the 2.252 acres situate just northwest of Old Greenville Road, State Route 613, as shown on an October 17, 2008 plat prepared by Barry E. Lotts, L.S., and referenced and described by metes and bounds in Exhibit 3 annexed to the Agreement.

4. The City and County have complied with the procedures contemplated by Virginia Code Section 15.2-3107.

5. The petition is otherwise in proper order.

WHEREFORE, IT IS HEREBY ADJUDGED, ORDERED, AND DECREED that:

In accordance with the Agreement, the boundary line between the City of Staunton and the County of Augusta IS CHANGED AND ESTABLISHED to include within the corporate limits of the City of Staunton all property embraced by the following metes and bounds description:

Beginning at a proposed City/County monument located 2,194' southwest of the center line intersection of Mona Circle and located on the northwest right-of-way line of Old Greenville Road (State Route 613) and a corner to James W. & Pamela C. Landes; thence with the northwest right-of-way line of Old Greenville Road,

S 57°11'48" W 201.16'

to an existing VDOT Monument; thence

S 48°40'52" W 7.11'

to a proposed City/County monument, said monument being a corner to Danny O. & Deborah O. Oneil; thence with Oneil and leaving Old Greenville Road,

N 44°50'41'' W 303.01'

to a proposed City/County monument, said monument being N 48°28'52" E 466.63' from City/County Monument No. 3; thence with the original City/County line and leaving Oneil,

N 48°28'52" E 378.75'

to an existing City/County Monument No. 2, said monument being in the property line of James R. Corbett; thence with Corbett,

S 48°55'21" E 166.50'

to a proposed City/County monument, said monument being a corner to Corbett and the aforementioned Landes; thence with Landes,

S 43° 27'39" W 160.00'

to a proposed City/County monument; thence

S 35°06'31'' E 154.86'

to the beginning, containing 2.252 acres of land and being the same property as shown on plat entitled “Plat Showing Annexation Boundary of 2.252 Acres of Land Between The City Of Staunton And The County Of Augusta”: Dated October 17, 2008.

It is FURTHER HEREBY ADJUDGED, ORDERED, AND DECREED that:

The new boundary line between the City and the County as established herein shall become effective at midnight on December 31, 2008;

This Order shall be entered in the land records of the court and indexed in the names of the City of Staunton and the County of Augusta;

The Clerk shall send a certified copy of this Order to the Clerk of the Circuit Court of the County of Augusta to be recorded in the land records of such court and indexed in the names of the City of Staunton and the County of Augusta;

The Clerk shall also send certified copies of this Order to the Secretary of the Commonwealth of Virginia, the Clerk of Council of the City of Staunton, and the Clerk of the Board of Supervisors of Augusta County; and

Each of the parties shall bear its own costs and expenses except as otherwise provided in the Agreement.
