2.14.010 Created – Membership.

A police reserve corps (hereinafter referred to as the “reserve”) is created and established as an organization which shall be composed of persons who have been appointed and sworn in as members thereof (sometimes hereinafter referred to in the singular as “member” or in the plural as “members”) by the Chief of Police. The number of members of the reserve shall be determined by the Chief of Police but shall not exceed 20. Both men and women shall be eligible to qualify to become members. Members shall be volunteer workers and shall not be or be deemed to be employees of the City for any purpose and shall serve gratuitously. (Ord. C-189 § 1, 1989)

2.14.020 Qualifications.

A. The Chief of Police shall establish the requirements to be met by persons to qualify to become members of the reserve. Such requirements may include but need not be limited to physical, mental, aptitude, personality inventory and character standards, and the successful completion of a training program. An examination to determine physical qualifications may be made at the expense of the City.

B. Whenever all of the requirements to qualify to become a member have been met by any person and he/she shall have certified in writing that he/she has read the provisions of this chapter, he/she may be appointed and sworn in as a member by the Chief of Police. However, the Chief of Police, with or without cause therefor, need not appoint and swear in any particular person as a member. (Ord. C-189 § 2, 1989)

2.14.030 Termination of membership.

A. The Chief of Police, without cause therefor, may terminate the membership of any member at any time and any member may resign as such at any time by written notification thereof to the Chief of Police.

B. Any member who shall cease to be such shall immediately surrender all property of the City which has been issued to him/her. (Ord. C-189 § 2, 1989)

2.14.040 Increase or decrease in membership.

The Chief of Police may either decrease the number of members of the reserve or, subject to the restrictions and limitations contained in this chapter, increase the number of members thereof. (Ord. C-189 § 2, 1989)

2.14.050 General authority – Promulgation of rules and regulations.

A. The Chief of Police, subject to the restrictions and limitations contained in this chapter, shall have complete authority and control over the reserve and its members and may delegate the exercise thereof, in whole or in part, to any of his subordinates.

B. The Chief of Police or any of his subordinates whom he has designated therefor may establish, by order which may be changed from time to time, rules and regulations governing the reserve and its members, providing for the maintenance of discipline and the assigning of members to perform duties. 2.14.060 Compensation.

Each member of the reserve shall serve voluntarily as such for at least 16 hours each calendar month, for which he/she shall not be paid any sum for salary, wages or compensation for services rendered. (Ord. C-189 § 4, 1989)

2.14.070 Powers and duties.

Each member shall have the same power and authority, except to the extent that the same may be restricted or limited by the Chief of Police, as does a regular Police Officer while he/she is serving as such. However, each member at all times other than while serving as such:

A. Shall not have status as a Police Officer or as a Peace Officer;

B. Shall not have any power, authority or duties as a Police Officer or as a Peace Officer; and

C. Shall not represent himself/herself, identify or hold himself/herself out to be a Police Officer or a Peace Officer. (Ord. C-189 § 4, 1989)

2.14.080 Uniforms and equipment.

A. Each member of the reserve may be issued at City expense and at no expense to him/her, items as follows:

1. Equipment which may include, but not be limited to, badges, collar insignia and shoulder patches, all of which shall be identical to those issued to regular officers; and

2. An identification card which shall show him/her as being a member of the reserve.

B. Each member of the reserve will provide, at his/her own expense, uniforms which shall meet the specifications to be determined by the Chief of Police and may be provided by the City within budgetary constraints.

C. Each item which is issued to a member of the reserve, whether or not hereinabove mentioned, shall remain the property of the City. (Ord. C-189 § 5, 1989)

2.14.090 Insurance.

An insurance policy may be obtained at the expense of the City for the purpose of providing benefits to applicants or members suffering or sustaining injury or death as a proximate result of service or training as an applicant for any member of the reserve. Liability insurance for applicants or members may also be obtained at the expense of the City. The benefits provided by the aforementioned insurance policies shall be to the exclusion of all others and the City shall not be liable to applicants or members for any benefit in addition thereto. 2.14.100 Civil defense duties.

The City may register all regular members of the police reserve as civil defense workers, as provided under Washington State law. (Ord. C-189 § 8, 1989)

2.14.110 Violation – Penalty.

It shall be a misdemeanor, punishable by imprisonment not to exceed 90 days or by a fine not to exceed $1,000, or both, for any person, not a member of the reserve:

A. To wear, display or carry, as the case may be, any items which shall have been issued to any member of the reserve; or

B. To represent, identify or hold himself/herself out in any manner whatsoever to be a member of the reserve or to have any connection with the reserve. (Ord. C-189 § 6, 1989)
