15.01.010 Title.
The regulations contained within this title shall collectively be known as AHMC Title 15 and may be referred to as “this title.” (Ord. C-800 § 4, 2013)
15.01.020 Purpose.
The purpose of this title shall be as set forth in the codes and regulations adopted herein. Notwithstanding anything in this title or adopted codes to the contrary, this title and the adopted codes shall be administered for the benefit of the health, safety and welfare of the general public and shall not be construed to establish any duties to protect or benefit any particular person or class of persons. 15.01.030 Adoption of referenced codes.
The City of Airway Heights hereby adopts the following codes, as amended by the Washington State Building Code Council pursuant to Chapter 19.27 RCW and RCW 19.27.020, for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and penalties:
A. The 2012 International Building Code (IBC), 2012 International Existing Building Code, and ICC/ANSI A117.1-2009, published by the International Code Council, Inc., as adopted and amended by Chapter 51-50 WAC and Chapter 70.92 RCW. The following appendices are specifically adopted:
1. Appendix E, Supplementary Accessibility Requirements.
2. Appendix F, Rodent Proofing.
3. Appendix H, Signs.
4. Appendix I, Patio Covers.
5. Appendix J, Grading.
B. The 2012 International Residential Code (IRC), published by the International Code Council, Inc., as adopted and amended by Chapter 51-51 WAC; provided, that Chapters 11 and 25 through 43 are not adopted. The following appendices are specifically adopted:
1. Appendix F, Radon Control Methods.
2. Appendix G, Swimming Pools, Spas, and Hot Tubs.
3. Appendix H, Patio Covers.
4. Appendix J, Existing Buildings and Structures.
5. Appendix M, Home Day Care – R-3 Occupancy.
C. The 2012 International Mechanical Code (IMC), published by the International Code Council, Inc., as adopted and amended by Chapter 51-52 WAC.
D. The 2012 International Fire Code (IFC), published by the International Code Council, Inc., as adopted and amended by Chapter 51-54A WAC, including those standards specifically referenced in the International Fire Code; provided, that the following appendices are specifically adopted:
1. Appendix B, Fire Flow Requirements for Buildings.
2. Appendix C, Fire Hydrant Locations and Distribution.
3. Appendix D, Fire Apparatus Access Roads.
4. Appendix F, Hazard Ranking.
5. Appendix H, Hazardous Materials Management Plan (HMMP) and Hazardous Materials Inventory Statement (HMIS) Instructions.
6. Appendix I, Fire Protection Systems, Noncompliant Conditions.
7. Appendix J, Emergency Responder Radio Coverage.
8. Appendix K, Wildlife and Urban Interface Code.
The rules adopted by the Washington State Building Code Council established standards for making buildings and facilities accessible to and usable by the physically disabled or elderly persons as provided in RCW 70.92.100 through 70.92.170. In case of conflict among the codes enumerated in subsections (A), (B), (C), and (D) of this section, the first-named code shall govern over the following.
E. The 2012 Uniform Plumbing Code (UPC) and Uniform Plumbing Code Standards, published by the International Association of Plumbing and Mechanical Officials as adopted and amended by Chapter 51-56 WAC; provided, that Chapters 12 and 15 of this code are not adopted; provided further, that those requirements of the Uniform Plumbing Code relating to venting and combustion air of fuel-fired appliances as found in Chapter 5 and those portions of the code addressing building sewers are not adopted; and the following appendices are specifically adopted:
1. Appendix A, Rules for Sizing Water Supply.
2. Appendix B, Combination Waste and Vent.
3. Appendix I, Installation Standards.
F. The 2012 International Fuel Gas Code (IFGC) as published by the International Code Council, Inc., as adopted and amended by WAC 51-52-21000, except that the standards for liquefied petroleum gas installations shall be 2011 Edition of the NFPA 58 (Liquefied Petroleum Gas Code) and 2012 Edition ANSI Z223.1/NFPA 54 (National Fuel Gas Code).
G. The 2012 International Energy Conservation Code (IECC) of Washington State, Commercial, Chapter 51-11C WAC, and Residential, Chapter 51-11R WAC, as adopted and amended.
H. The 2012 International Property Maintenance Code.

15.01.040 Code precedence.
A. The Washington State Building Code Act, Chapter 19.27 RCW, establishes the following order of precedence among the documents adopted as parts of the Washington State Building Code:
1. International Building Code, Standards and Amendments, Chapter 51-50 WAC;
2. International Residential Code, Standards and Amendments, Chapter 51-51 WAC;
3. International Mechanical Code, Standards and Amendments, Chapter 51-52 WAC;
4. International Fire Code, Standards and Amendments, Chapter 51-54A WAC;
5. Uniform Plumbing Code, Standards and Amendments, Chapter 51-56 WAC.
B. Where there is a conflict between codes, an earlier named code takes precedence over a later named code. In the case of conflict between the duct insulation requirements of the International Mechanical Code and the duct insulation requirements of the International Energy Conservation Code (IECC) of Washington State, the IECC shall govern.
C. Where, in any specific case, different sections of this code specify different materials, methods of construction or other requirements, the most restrictive shall govern. Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall be applicable. (Ord. C-800 § 7, 2013)
15.01.050 Partial invalidity.
In the event that any part or provision of the adopted codes is held to be illegal or void, this shall not have the effect of making void or illegal any of the other parts or provisions. (Ord. C-800 § 8, 2013)
15.01.060 Other codes and standards.
In addition to the above, and except as modified by this title, the following codes and standards are hereby adopted and shall have the same force and effect as if fully set forth herein. Specifically:
A. Chapter 296-150 WAC, specifically Chapters 296-150C, 296-150F, 296-150M, and 296-150P, inclusive, as amended.
B. In addition, the Manufactured Housing Inspection Manual as published by the Washington Manufactured Housing Association is to be used as a supplement to and reference for the aforementioned administrative code. In case of conflict, the Building Official shall make a determination as to which code shall govern. (Ord. C-800 § 9, 2013)
15.01.070 Modifications.
Whenever there are practical difficulties involved in carrying out the provisions of this title or other pertinent laws and ordinances, the Building Official may grant modifications for individual cases; provided, he shall first find that a special individual reason makes the strict letter of this title impractical and that the modification is in conformity with the intent and purpose of this title and that such modification does not lessen any fire protection requirements or any degree of structural integrity or any health or safety requirements of this title, or other pertinent laws and ordinances.
