MISCELLANEOUS TRAFFIC REGULATIONS

10.08.030 Speed limit on Highway 502 between west city boundary and State Highway 503.

The speed limit of the city of Battle Ground on Highway 502 at its intersection on the westerly boundary of the city of Battle Ground at N.E. 112th Avenue, proceeding easterly to its junction with State Highway 503, shall be forty miles per hour. (Ord. 227 § 1, 1975)

10.08.040 Speed limit within city between Highway 502 and State Highway 503.

The speed limit from the intersection of Highway 502 with State Highway 503, proceeding westerly to the west city boundary, shall not exceed forty miles per hour. (Ord. 227 § 2, 1975)

10.08.050 Compression brakes prohibited.

A.    Except as provided in this section, no person shall use motor vehicle brakes within the city limits that are in any way activated or operated by the unmuffled compression of the engine of that motor vehicle or any part thereof. Said unmuffled compression brakes are also known as “Jakes brakes” or “Jacobs brakes.”

B.    This section shall not apply to vehicles of any fire department whether or not responding to an emergency.

C.    It shall be an affirmative defense to prosecution under this section that the unmuffled compression brakes were applied in an emergency and were necessary for the protection of persons and/or property.

D.    The traffic engineer of the city of Battle Ground shall have the authority to post appropriate signs consistent with these provisions.

E.    Any person violating the provisions of this chapter shall be deemed to have committed a traffic infraction and shall be assessed the monetary penalty in an amount not to exceed two hundred fifty dollars. (Ord. 10-01 § 1, 2010)

10.08.060 Speed limits within the city of Battle Ground.

No person shall operate a motor vehicle at a speed greater than 25 mph upon any street within the corporate limits of the city of Battle Ground, except where specifically posted to the contrary, or on which another speed limit is established. After an engineering and traffic investigation by the city engineer, the speed limit modification can then be adopted by resolution of the city council as provided in WAC 308-330-270.
