13.08.010 Definitions.

Definitions and terms as used in this chapter, unless the context otherwise indicates, shall be as follows:

Block. In platted areas, block lengths shall be as platted, irrespective of length. In unplatted areas, blocks shall be considered to be 500 feet in length.

“Existing street” means a present traveled way with a minimum width of 18 feet of hard surfacing irrespective of whether it has been accepted by the city for maintenance. A hard surfaced street shall be a street consisting of either portland cement or asphaltic concrete as a wearing surface.

“Special street improvement fund” means a special fund established by the city for the deposit of moneys to be used only for the improvement of streets within the city that abut or provide access to property paying to said fund. This fund to be invested by the treasurer until used with all interest accrued added to said fund. [Code 1980 at § 11.48.010].

13.08.020 Substandard streets – Criteria.

An existing street is substandard for a given improvement if it is less than the standards set forth in Chapter 13.04 BMC. [Code 1980 at § 11.48.020].

13.08.030 Street improvements required prior to building permit issuance.

Building permits for new construction or for the maintenance or renovation of 50 percent or more of an existing structure shall not be issued where the premises to be improved abut on a street, the improvement of which is substandard to the type of development contemplated; provided, that a permit may be issued if:

A. There is an existing street fronting the premises to be improved and the owner of the property to be improved executes an LID commitment; or

B. The owner of the property requesting the permit constructs, bonds for or pays in advance for the construction of a minimum standard street fronting the property and extending to an existing street and executes a LID commitment. [Ord. 10021 § 5, 1989].

13.08.050 Variances.

A variance from any of the requirements specified by this chapter may be granted by the hearing examiner upon the recommendation of the staff and when in the best interest of the public welfare. Such variance may be granted when practical difficulties arise in the design and construction of streets due to topographic geological limitations or other problems inherent or peculiar to the area, or where the council finds that imposition of the required street width would be detrimental to the interest of the neighborhood. 13.08.060 Contract required for street improvement.

All streets constructed pursuant to the requirements of this chapter shall be constructed in accordance with the provisions of a contract between the person responsible for constructing the street and the city, providing at least:

A. Terms and conditions satisfactory to the city, including design and construction standards;

B. Requiring a permit to be issued before commencement of construction; and

C. In the discretion of the director of public works, appropriate security may be required covering construction performance and guaranteeing the construction after completion for a period of one year. [Ord. 9234 § 1, 1983; Ord. 8792 § 1, 1979].
