17.10.010 Purpose.

The purpose of this title is to regulate all divisions of land within the city of Bonney Lake in order to:

A. Provide clear standards and consistency between developments throughout the city;

B. Facilitate the implementation of the goals and policies of the city’s comprehensive plan;

C. Regulate the division of land in an orderly and predictable way;

D. Effectively and efficiently provide vital infrastructure to the citizens of Bonney Lake; and

E. Ensure compliance with the requirements of Chapters 36.70A and 58.17 RCW, and all other applicable laws of the state of Washington. (Ord. 1580 § 3, 2017).

17.10.020 Exemptions.

The provisions of this title apply to all divisions of land within the city of Bonney Lake, except for those divisions of land identified in RCW 58.17.040. (Ord. 1580 § 3, 2017).

17.10.030 Definitions.

For the purposes of this title the following terms shall have the meaning ascribed to them below:

A. Definitions for the following terms are adopted by reference from RCW 58.17.020 as presently constituted or as may be subsequently amended:

1. Block;

2. Dedication;

3. Final plat;

4. Lot;

5. Plat;

6. Preliminary plat;

7. Short plat.

B. Definitions for the following terms are adopted by reference from Chapter 18.04 BLMC as presently constituted or as may be subsequently amended:

1. Lot of record;

2. Panhandle access;

3. Panhandle lot;

4. Street.

C. As used in this title, the following terms and phrases shall have the following meanings:

1. “Divisions of land” means both subdivision and short subdivisions.

2. “Easement” means the grant of a right to use real property by its owner to the city for a municipal purpose, the owner retaining title to the property.

3. “Letter of credit” means a document issued by a bank that supports or backs up the credit of a party and provides security for the performance of the party’s obligations.

4. “Short subdivision” means the division of land into nine or less lots, tracts, parcels, or other division of land for the purpose of sale or lease.

5. “Subdivision” means a division of land into 10 or more lots or other divisions of land for the purpose of development or of transfer.

6. “Surety” means a bond, letter of credit, the deposit of a certified check in a city account, or other security acceptable to the city. (Ord. 1580 § 3, 2017).

17.10.040 Violations.

It shall be unlawful for any party to effect a division of land by transferring, selling, or contracting to sell any portion of a parcel or tract unless this title has been complied with. (Ord. 1580 § 3, 2017).
