18.02.010 Short title.

This title shall be known and may be cited as “the zoning code of the city of Bonney Lake.” (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.015 Legislative authority.

The zoning code of the city of Bonney Lake is enacted under the authority of Article XI, Section 11 of the Washington State Constitution, and Chapter 35A.63 RCW (Planning and Zoning in Code Cities). (Ord. 786 § 1, 1998).

18.02.020 Jurisdiction.

This code shall be effective within the corporate boundaries of the city of Bonney Lake, hereinafter “the city.” (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.025 Purpose.

The general purposes for this title are:

A. To encourage land use decision making in accordance with the public interest and applicable laws of the state of Washington;

B. To protect the general public health, safety and welfare;

C. To implement the Bonney Lake comprehensive plan’s goals, objectives and policies through land use regulations;

D. To provide for the economic, social and aesthetic advantages of orderly development through harmonious groupings of compatible and complementary land uses and the application of appropriate development standards;

E. To provide for adequate public facilities and services in conjunction with development; and

F. To promote general public safety by regulating development of lands containing physical hazards and to minimize adverse environmental impacts of development. (Ord. 786 § 1, 1998).

18.02.030 Conformance required.

A. After the effective date of this zoning code, no use or structure shall be established, substituted, expanded, constructed, altered, moved, maintained, or otherwise changed except in conformance with this title.

B. Creation of or changes to lot lines shall conform with the use provisions, dimensional and other standards and procedures in this title, and BLMC Title 14, Development Code Administration, and BLMC Title 17, Subdivisions.

C. All land uses and development authorized by this title shall be in conformance with the Bonney Lake Municipal Code, as well as any other local, state or federal law. Where a difference exists between this title and the other city regulations, the more restrictive requirements apply.

D. Where more than one part of this title applies to the same aspect of a proposed use or development, the more restrictive requirement shall apply.

E. Temporary uses or activities, conducted during an emergency event, or training exercise conducted at emergency sites, identified by the city shall not be subject to the provisions of this title. (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.040 Provisions are minimum requirements.

In interpreting and applying the provisions of this zoning code, such provisions shall be considered as the minimum requirements. (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.050 Interpretation.

A. In case of inconsistency or conflict, regulations, conditions or procedural requirements that are specific to an individual land use shall supersede regulations, conditions or procedural requirements of general application.

B. A land use includes the necessary structures to support the use unless specifically prohibited or the context clearly indicates otherwise.

C. All applicable requirements shall govern a use whether or not they are cross referenced in a text section.

D. Unless the context clearly indicates otherwise, words in the present tense shall include past and future tense, and words in the singular shall include the plural or vice versa. Except for words and terms defined in this title, all words and terms used in this title shall have their customary meanings. 18.02.060 Title in two parts.

The zoning code consists of two parts, the text portion hereof, and the zoning maps which are made part hereof by reference. (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.070 Severability.

If any part or parts of this code are for any reason held to be invalid, such decisions shall not affect the validity of the remaining portions of this title. (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.080 Effective date.

This code shall take effect five days after the date of its approval by the city council, posting and publication in accordance with law. (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.090 Establishment of districts.

In order to carry out the purposes and provisions of this zoning code, the uses of buildings or other structures, and of tracts of land, the following districts are established:

A. Residential Districts:

1. R-1, low-density residential district;

2. R-2, medium-density residential district;

3. R-3, high-density residential district;

4. RC-5, residential/conservation district.

B. Commercial Districts:

1. C-1, neighborhood commercial district;

2. C-2, commercial district;

3. MC, midtown core district;

4. E, Eastown district;

5. DC, downtown core;

6. DM, downtown mixed use;

7. PCM, planned community district.

C. Public Facilities Districts:

18.02.100 Exemptions from certain provisions.

Repealed by Ord. 1230. (Ord. 786 § 1, 1998; Ord. 515 § 4, 1982).

18.02.110 Rounding of fractions.

When a calculation results in a fraction, the number will be rounded up to the next higher whole number if the fraction is greater than one-half. If the fraction is less than one-half, the number will be rounded down to the next lower whole number. (Ord. 1641 § 11, 2020; Ord. 1355 § 4, 2010).

18.02.120 Land use table.

Land uses allowed, allowed as accessory, and allowed as conditional are listed for each zoning district in the land use table in Chapter 18.08 BLMC. (Ord. 1416 § 8, 2011).
