9.58.010 Offense described—Physical damage defined.

A.    A person is guilty of malicious mischief in the third degree if he knowingly and maliciously causes physical damage to the property of another, in an amount not exceeding two hundred fifty dollars, under circumstances not amounting to malicious mischief in the first or second degree as defined by the Washington State Statute.

B.    “Physical damage,” as used in this section, in addition to its ordinary meaning includes the alteration, damage or erasure of records, information, data or computer programs which are electronically recorded for use in computers. (Ord. 254 (part), 1979)
