2.42.010 Established.

There is hereby established and created a police department of the city to take the place of the office of the town marshal. All references to the office of the town marshal in the city ordinances shall be construed to mean the Buckley police department. (Ord. 904 § 2, 1976).

2.42.020 Duties.

It shall be the duty of the police department to enforce all ordinances duly enacted and passed by the city council and to do all things necessary towards the prosecution of offenders of the ordinances in a court of competent jurisdiction. (Ord. 904 § 3, 1976).

2.42.030 Police chief – Appointment and removal.

The police department shall have a police chief who shall be appointed and removed by the mayor of the city per civil service requirements. (Ord. 904 § 4, 1976).

2.42.040 Police chief – Powers and duties authorized.

(1) The police chief shall be in general charge of the police department. The police chief shall, subject to the approval of the mayor, promulgate such rules and regulations pertaining to the administration of the police department as he may deem necessary and proper.

(2) The police chief shall employ, subject to the approval of the mayor, such additional personnel including auxiliary patrolmen as shall be necessary to perform the duties referred to in this chapter. (Ord. 904 § 5, 1976).

2.42.050 Police chief and personnel compensation.

The police chief and such additional personnel as may be employed in the police department shall receive such compensation as the council shall provide from year to year in its biennial budget ordinance. (Ord. 05-24 § 3, 2024; Ord. 904 § 6, 1976).

2.42.060 Disposal of personal property in possession of department.

(1) Confiscated personal property and found personal property as turned in to the city police department shall be disposed of by said department at public auction.

(2) Property in the possession of the police department to be disposed of shall not be sold at public auction prior to a 60-day waiting period.

(3) Notice of public auction for the sale of said items shall be given at least two weeks prior to the sale of said property and shall be published according to city ordinance as to the method of said publication.

(4) The moneys derived from the public auction in the sale of the personal property as set out above shall go into the city’s general fund.

(5) The auction shall be under the direction of the chief of police of the city police department or his designated representative.

(6) The only items not to be sold at public auction will be pistols, rifles, or an illegal weapon of any sort or a weapon used in a crime. (Ord. 975 §§ 1 – 6, 1979).

2.42.070 Petty cash fund establishment.

There is established a petty cash fund for the Buckley police department. Said fund shall be used by the staff of the police department to make change at times of collection of booking fees, dog licenses, and concealed weapons permits. The amount of money in said petty cash fund shall not exceed $100.00. (Ord. 39-99 § 1, 2000).

2.42.080 Custodian.

The custodian shall be the chief of police or his or her delegate. (Ord. 39-99 § 2, 2000).
