No action shall be commenced against Cascade Water Alliance in which monetary damages are being claimed until a written Claim for Damages has been presented to and filed with the Director of Finance of Cascade Water Alliance at Cascade’s business offices at 520 112th Ave. NE Suite 400, Bellevue, WA 98004. Such a claim must name the claimant, include the claimant’s address, specify the date and location of the claimed loss, describe any alleged act or omission on the part of Cascade Water Alliance and the basis upon which liability is being asserted against Cascade Water Alliance, identify any known witnesses, detail the nature and extent of the injury or damage sustained and state the amount being claimed. The claim form must be signed by the claimant or an authorized representative prior to its filing. [Res. 2015-02 § 1].

2.35.020 Investigation.

All claims for damages shall be investigated and evaluated by Cascade Water Alliance with the assistance of its attorney and insurer or risk management pool. In anticipation of litigation regarding such claims, the Director of Finance may request reports from all interested staff and Member staff concerning any claim and such reports shall be prepared to assist Cascade Water Alliance’s attorney in defense of Cascade Water Alliance and shall constitute and be treated as privileged communications. 2.35.030 Lawsuit.

A lawsuit based upon the allegations of a Claim for Damages may not be instituted against Cascade Water Alliance within 60 days of the filing of such claim. [Res. 2015-02 § 1].
