1.05.010 Definitions.

“Adult” means a person who is either 18 years of age or older, married, or otherwise emancipated.

“Business Committee” means the governing body of the Confederated Tribes of the Chehalis Reservation under Article IV, Section 1 of the Constitution and Bylaws of the Confederated Tribes of the Chehalis Reservation.

“Chehalis Tribal community” means enrolled members of the Chehalis Tribe, residents of the Chehalis Reservation and residents of land owned in trust by the Chehalis Tribe.

“Chehalis Tribal member” or “member” means an enrolled member of the Confederated Tribes of the Chehalis Reservation.

“Child” means any person under the age of 18 years who is the biological, foster, or adoptive child of a member of the Chehalis Tribe.

“Constitution” means the Constitution of the Confederated Tribes of the Chehalis Reservation ratified July 11, 1973, or as subsequently amended.

“Federal government” includes the United States of America, the Department of Housing and Urban Development, or any other agency or instrumentality, corporate or otherwise, of the United States of America.

“General Council” means the Community Council under Article IV, Section 4 of the Constitution and Bylaws of the Confederated Tribes of the Chehalis Reservation.

“Indian tribe” means any tribe, band, nation, clan, or other organized group or community of Indians recognized as eligible for the services provided to Indians by the Secretary of the Interior of the United States because of their status as Indians, including any Alaskan Native village as defined in Section 3(c) of the Alaska Native Claims Settlement Act (35 Stat. 688, 689), as amended.

“Jurisdiction” or “the Tribe’s jurisdiction” means the Chehalis Reservation and all lands outside of the Reservation held in trust for the Chehalis Tribe. All persons who enter Tribal lands shall be deemed to have given implied consent to the jurisdiction of the Tribe and shall be subject to the provisions of this code.

“Nonenrolled person” or “nonmember” means any person whether Indian or non-Indian, who is not an enrolled member of the Chehalis Tribe.

“Person” shall mean any individual, partnership, corporation, firm, company, organization, joint stock company, municipal corporation, city, school district or corporation, county, town, association, trust, estate, government unit or other legal entity.

“Reservation” means all land within the jurisdiction of the Confederated Tribes of the Chehalis Reservation.

“Resolution” means a formal statement of a decision by a Tribal entity.

“Secretary” means the Secretary of the Confederated Tribes of the Chehalis Reservation.

“State” means the State of Washington.

“Treaty and executive order rights” means those rights protected by and incidental to use and enjoyment of all treaties and executive orders between the Confederated Tribes of the Chehalis Reservation and the United States of America.

“Tribal Center” shall mean the administration building of the Confederated Tribes of the Chehalis Reservation.

“Tribal Court” and “Court” mean the Chehalis Tribal Court established under Chapter 3.05 CTC, courts and procedures.

“Tribal lands” means all lands within the jurisdiction of the Confederated Tribes of the Chehalis Reservation.

“Tribal law or custom” means the written or unwritten law or custom of the Confederated Tribes of the Chehalis Reservation, and, where appropriate, may be based on the written or oral testimony of a qualified elder, historian, or other Tribal representatives.

“Tribe” and “Chehalis Tribe” mean the Confederated Tribes of the Chehalis Reservation. 1.05.020 Rules of construction.

A. This code shall be liberally construed to give full effect to the objectives and purposes for which it was enacted.

B. In this code, unless otherwise expressly provided:

1. The masculine includes the feminine;

2. The singular includes the plural;

3. “Includes” and “including” are not limiting;

4. “Or” is not exclusive;

5. May. When used in this code, the word “may” indicates a discretionary decision to be made; and

6. “Shall” means a mandatory action ministerial in nature. 1.05.030 Fees, penalties and fines.

Fees, penalties, fines and other amounts established by this code are subject to revision by the Business Committee from time to time. [Res. 2016-17.]

1.05.040 Sovereign immunity.

A. Nothing in this code shall be construed as waiving the sovereign immunity of the Tribe or its enterprises, agents, employees or officials.

B. No manager, officer or employee of the Tribe is authorized, and he/she shall not attempt, to waive the immunity of the Tribe.

C. Damage suits against any employee, officer, agent, prosecutor, judge, or manager of the Chehalis Tribe or any of its departments, divisions, organizations or enterprises for disputes arising under this code are prohibited. 1.05.050 Jurisdiction.

1.05.060 Severability.

If any portion of this code or its application to any person or circumstance is held invalid, the remainder of this code or its application to other persons or circumstances is not affected.
