10.74.010 Purpose.

The purpose of this chapter is to protect and preserve city streets and to prevent traffic damage by authorizing placement of restrictions, including but not limited to weight limits, speed reductions and closure, whenever a city street by reason of rain, snow, climatic or other conditions will be seriously damaged or destroyed unless the operation of vehicles or any class of vehicles thereon is prohibited, restricted, the permissible weights thereof reduced or the maximum speed thereon reduced. 10.74.020 City engineer authorization.

The city engineer may impose those restrictions authorized by RCW 46.44.080 and 47.48.010, as now exist or as may be hereafter amended, for a designated period of time, which period may be indeterminate, where in the opinion of the city engineer a city street will be seriously damaged or destroyed by reason of rain, snow, climatic or other conditions, or unrestricted or continued use by vehicles or any class of vehicles will greatly damage the city street, or will be dangerous to traffic, or where the city street is being constructed, altered, repaired, improved, or maintained in such a manner as to require that use of the city street or any portion thereof be closed or restricted for any period of time. 10.74.030 Weight limitations.

When in the opinion of the city engineer weight restrictions are necessary on a city street or any portion thereof, no person shall operate any vehicle, except as authorized by Section 10.74.040, with a gross weight upon any tire concentrated upon the surface of the city street in excess of the following load limitations:

10.74.040 Exemptions.

The following vehicles are exempt from the weight limitations established herein:

A. Public transportation buses;

B. School buses;

C. Public and private emergency vehicles;

D. Public utility district vehicles;

E. Motor trucks transporting perishable commodities necessary for the health and welfare of local residents;

F. City of Chelan vehicle providing services for the city, including but not limited to waste collection. (Ord. 1031 § 1 (part), 1996).

10.74.050 Notice and effective date.

A. The city engineer or his designee shall cause notice of any restrictions imposed pursuant to this chapter, including the effective date, which shall be no sooner than three days after the publication and posting of notice, to be published in one issue of a newspaper of general circulation within the city, and shall cause notice to be posted at each end of any street or portion thereof subject to the restrictions.

B. The city engineer or his designee shall remove such posted signs when the restriction has been lifted. (Ord. 1031 § 1 (part), 1996).

10.74.060 Penalty.

Any person, firm, corporation or association failing to comply with any of the provisions of this chapter shall be guilty of a misdemeanor and shall, in addition to any penalty for violation of the provisions of this section, be liable in any civil action instituted in the name of the city for any damages occasioned to that city street as the result of disregarding the restrictions as set forth in this chapter.
