13.33.010 Definitions.

A. “Accessory dwelling unit (ADU)” is defined in Section 19.10.040 of this code as now exists or as may be hereafter amended.

B. “Family,” for purposes of this chapter, means an individual or two or more persons related by blood, marriage, adoption or legal guardianship.

C. “Family ADU” means an ADU occupied by a family member of a resident of the primary dwelling unit and where no rent is paid by the family member for the use of the family ADU. (Ord. 1068 § 1 (part), 1997).

13.33.020 Rate reduction – Applicable utilities.

A utility rate reduction shall be applied to the residential monthly utility bills of a family ADU, in accordance with the terms of this chapter. These ADUs will be identified as family ADUs for purposes of this chapter. Utility rates for family ADUs shall be as follows:

A. Water.

1. No monthly charge in addition to that of the primary residence;

2. No connection fee.

B. Sewer.

1. No monthly charge in addition to that of primary residence;

2. No connection fee.

C. Sanitation. No monthly charges in addition to those of primary residence. (Ord. 1068 § 1 (part), 1997).

13.33.030 Family ADU discount.

A. Application for family ADU discount shall be obtained from and filed with the city clerk. The application shall be on a form prescribed by the city clerk, and shall contain the information necessary to evaluate the applicant’s qualification for the family ADU utility rates prescribed herein, including but not limited to those requirements set forth in Section 17.20.030 of this code as now exist or as may be hereafter amended.

B. Submission of an application for a family ADU rate shall constitute a verification by the applicant that all information provided in such application is true and correct to the best of the applicant’s knowledge.

C. Once approved by the city clerk, the application shall become effective during the next billing cycle falling thirty days after approval of the application.

D. Each application is effective for twelve months commencing the first month the family ADU rate becomes effective for the applicant. The applicant shall be solely responsible to reapply for successive twelve-month periods of eligibility for the family ADU utility rate. (Ord. 1068 § 1 (part), 1997).

13.33.040 Penalty for false information.

Any individual willfully providing false information to the city in an application for the family ADU utility rate shall forfeit the eligibility for future family ADU discounts and shall be guilty of a misdemeanor punishable as set forth in Section 1.24.010 of this code, as the same now exists or as may be hereafter amended. Any such individual shall be required to repay the amount of any family ADU reduction received based upon such false information, together with interest at the rate of eighteen percent per annum until repaid in full. These penalties are in addition to and not in lieu of any injunctive relief or civil action to enforce compliance with city ordinances that may be brought by the city. (Ord. 1068 § 1 (part), 1997).
