JOINT CITY-COUNTY HOUSING AUTHORITY

1.284.010 Purpose.

The board of commissioners of the county of Chelan, Washington, determines, finds and declares, in pursuance of the Housing Authorities Law, as amended, of the state of Washington that:

(1)    Unsanitary and unsafe inhabited dwelling accommodations exist in the county of Chelan, Washington; and

(2)    There is a shortage of safe and sanitary dwelling accommodations in the county of Chelan, Washington, available to persons of low income at rentals they can afford; and

(3)    There is a need for a housing authority to function in the county of Chelan, Washington; and

(4)    The housing authority of the city of Wenatchee (“Wenatchee Housing Authority”), activated by resolution of the city of Wenatchee, Washington, on April 21, 1981, has since its creation operated to meet the foregoing deficiencies and shortages in the city of Wenatchee, by financing, planning, undertaking, constructing and operating housing projects in such area; and

(5)    By agreement, the Wenatchee housing authority has also operated in other cities or areas in Chelan County where similar housing conditions or shortages exist; and

(6)    The interests of the county of Chelan would be served by the formation of a joint city-county housing authority to serve the county of Chelan as well as the area within the city of Wenatchee, pursuant to RCW 35.82.300, with the area of operation to be the combined area of operation of each city and county, as defined by RCW 35.82.020(6). 1.284.020 Created.

(a)    The city commissioners of the city of Wenatchee, Washington, and the board of directors of the Wenatchee housing authority have agreed to the formation of a joint city-county housing authority, and further agreed that the housing authority of the city of Wenatchee shall move forward to implement such agreement.

(b)    The county of Chelan forms, together with and subject to approval by the city of Wenatchee, a joint city-county housing authority.

(c)    The name of said joint authority shall be “housing authority of Chelan County and the city of Wenatchee” (hereinafter “joint authority”).

(d)    Said joint housing authority shall be, pursuant to 35.82 RCW and specifically RCW 35.82.070, a nonprofit, separate, quasi-municipal corporation under the laws of the state of Washington.

(e)    Upon activation of the joint authority, the Wenatchee housing authority shall be deactivated. The assets of the Wenatchee housing authority, including both real and personal property, and funding sources, shall be transferred to the joint authority. The debts of the Wenatchee housing authority shall be assumed by the joint authority. Any debt or other liability of the Wenatchee housing authority which preexists the creation of the joint authority shall not be assumed by nor assigned to Chelan County and/or the City of Wenatchee.

(f)    The joint authority shall be self-supporting. Neither the city of Wenatchee nor Chelan County shall be liable for current expenses, long-term debt, or contingent liability of the joint authority.

(g)    Upon deactivation of the joint authority, assets shall be applied and distributed pursuant to RCW 35.82.325—provided, however, that the Wenatchee housing authority, if reactivated at the time of said deactivation, shall be entitled to the return of all assets held by it prior to the formation of the joint authority and the Wenatchee housing authority shall assume all debts encumbering and/or associated with said assets. 1.284.030 Membership.

There shall be eleven initial members of the board of the joint authority, with each member seat numbered and determined as follows:

(a)    Initially, each of the three Chelan County commissioners will appoint to three year terms, two board members from within his/her district; one member shall be from anywhere in the respective district and one member shall be from within the city of Wenatchee in such district, for a total of six board positions identified as follows:

Position 1. Member initially and subsequently appointed by first district county commissioner from within first district in county.

Position 2. Member initially and subsequently appointed by second district county commissioner from within second district in county.

Position 3. Member initially and subsequently appointed by third district county commissioner from within third district in county.

Position 4. Member initially appointed by first district county commissioner from within first district in city of Wenatchee; upon expiration or earlier termination or vacancy, member appointed by the mayor of the city of Cashmere from anywhere in Chelan County.

Position 5. Member initially appointed by second district county commissioner from within second district in city of Wenatchee; upon expiration or earlier termination or vacancy, member appointed by the mayor of the city of Chelan from anywhere in Chelan County.

Position 6. Member initially appointed by third district county commissioner from within third district in city of Wenatchee; upon expiration or earlier termination or vacancy, member appointed by the mayor of the city of Entiat from anywhere in Chelan County.

(b)    The current board of the Wenatchee housing authority, consisting of five members, will also serve as board members of the joint authority, serving out their respective terms as follows:

Position 7. Member is currently serving a term which expires April 1999; and upon expiration of such term or vacancy of the position it will thenceforth be appointed by the mayor of the city of Leavenworth from within Chelan County and upon three year terms.

Position 8. Member is currently serving a term which expires April 2001; and upon expiration of such term or vacancy of the position, it will thenceforth be appointed by the mayor of the city of Wenatchee from within such city and upon three year terms.

Position 9. Member is currently serving a term which expires April 1999; and upon expiration of such term or vacancy of the position, it will thenceforth be appointed by the mayor of the city of Wenatchee from within such city and upon three year terms.

Position 10. This position will initially be held by Peter Hill, who is currently serving a term which expires April 2002; and upon expiration of such term or vacancy of the position, it will henceforth be appointed by the mayor of the city of East Wenatchee from within such city and upon three year terms, so long as the housing authority is authorized to operate within such city.

Position 11. This position will initially be held by Rick Linder, who is currently serving a term which expires April 2002; and upon expiration of such term or vacancy of the position, it will henceforth be appointed by the chair of Douglas County commission from within such county and upon three year terms, so long as the housing authority is authorized to operate within such county. 1.284.040 Insurance.

All members of the board of the joint authority and all staff employed by the joint authority shall be covered by a comprehensive errors and omissions insurance policy providing a minimum of two million dollars coverage per occurrence. (Res. 98-1 § 15, 1/5/98).
