8.34.010 Short title.

This chapter and amendments thereto shall be known and may be cited as the “Chelan County seasonal road closure resolution.” (Res. 2014-124 (Exh. A) (part), 12/9/14: Res. 2012-110 (Exh. A) (part), 11/20/12).

8.34.020 General purpose.

The purpose and intent of this chapter is to prevent great damage to portions of Chelan County roads resulting from vehicle traffic during the periods of freezing and thawing conditions which occur every year upon the county roads listed in this chapter and to protect wintering mule deer habitat. 8.34.030 County roads designated for seasonal closure—Exceptions.

(1) The county roads listed below shall be closed to general vehicle traffic every year during the times specified:

(2) The following persons may travel by vehicle upon the listed county roads, subject to any road weight or speed restrictions, during the time that such roads are closed to general vehicle traffic under this chapter:

(A) Residents whose property is accessed by a road closed to general vehicle traffic under this chapter;

(B) Landowners, and others in lawful possession and control of land with access by a road closed to general vehicle traffic under this chapter;

(C) Drivers and occupants of emergency vehicles; and

(D) Drivers and occupants of motor trucks transporting commodities necessary for the health and welfare of local residents. (Res. 2014-124 (Exh. A) (part), 12/9/14: Res. 2012-110 (Exh. A) (part), 11/20/12).

8.34.040 County engineer—Barriers—Signs.

The county engineer is authorized and directed to erect and maintain such gates, barriers and road closing signs as are appropriate and necessary to implement the yearly closing of the roads listed in this chapter. (Res. 2014-124 (Exh. A) (part), 12/9/14: Res. 2012-110 (Exh. A) (part), 11/20/12).

8.34.050 Penalty for violation.

Any unauthorized person, firm, or corporation knowingly disregarding a county road closing under this chapter shall be guilty of a misdemeanor, punishable by imprisonment in jail for a period not to exceed ninety days or a fine not to exceed one thousand dollars, or both such fine and imprisonment, and shall in addition to any penalty for violation of the provisions of this section, be liable in any civil action instituted in the name of Chelan County, Washington, for any damages occasioned to such county road as the result of disregarding such closing. 8.34.060 Severability.

If any section, subsection, paragraph, sentence, clause, or phrase of this chapter is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining parts of the chapter.
