8.90.010 Purpose.

Fees required in this chapter are intended to reimburse the public works department for ordinary, typical department expenses related to reviewing and processing applications. (Res. 2022-90 (Exh. A), 9/20/22; Res. 2022-70 (Exh. A), 7/19/22; Res. 2014-26 (Att. A (part)), 3/11/14).

8.90.020 Public works department fee schedule.

The Chelan County public works department shall require application fees as follows:

Section I—Land Use Permits

This section includes initial fees for land use related activities.

Section IV—Land Use Permits/Resubmittal and Deviation Fees

Fees in this section are atypical for most land use permit applications or are based on resubmittals and multiple review costs associated with land use permit reviews or the additional work necessary to process deviation requests. Initial fees in Section I include two complete department review cycles of each required submittal. Fees in Section IV may be assessed for each additional resubmitted document due to significant document changes by the applicant after the original review has been completed or for recurring errors/omissions that are not addressed after comments have been issued by the department after two review iterations.

Section V—Special Engineering Review

Section V fees are assessed on a per-hour basis for unique or special circumstances where a statutory engineering review is required. This may include, but is not limited to, drainage, culvert, or geotechnical work typically not involving plats or land use applications. Where structural elements requiring review are included in platting, these fees may be assessed. Estimated cost and schedule will be provided at time of submittal.

Section VI—Road Approach Permits

Fees for this section are required for a new or unpermitted existing access to a county road, or when required by a land use change. Fees will be waived for unpermitted driveways in existence prior to 2010, provided there is no change in the use, design or location.

Section VII—Right-of-Way Permits

Right-of-way permits are issued for any work that occurs within the county right-of-way. Right-of-way permit fees are based on land-disturbing activities associated with such work. The county engineer may waive fees for private land-disturbing activities within the county right-of-way that serve a public benefit, as determined by the county engineer. Right-of-way permit fees do not include project bonding, when required.

Section IX—Road Vacation Petitions

The application fee for vacation of a county road, or a portion thereof, is made as a deposit for county expenses incurred in the road vacation process, including (but not limited to): surveying, appraisal and administrative costs, and real property cost (if applicable). The county will refund the unexpended portion of a deposit, or if the amount of costs and compensation exceed the amount of the deposit, the principal petitioner shall be responsible to pay the additional costs and compensation.

Section XII—Utility Permits and Franchises

Utility permits and franchises are issued for permanent features that are located within county road R/W by other parties. Section XII fees may be waived by the county engineer for existing individual, private utility features where permit is issued for the purpose of documenting and/or locating existing facilities within the county R/W. Fees will apply for all new installations and/or expansion of existing systems and/or franchises.

Section XIV—Event Permits

Event permits are required for any organized activity, including races, parades, street fairs, etc., that include the use of county roads. See Chapter 9.26. If requested and approved, public works or sheriff’s department resources utilized to support the event will be reimbursed on an actual expense basis by the applicant. Nonprofit organizations will not be charged the permit fee but will be responsible for reimbursement of county resources, if applicable. Event permits must be applied for at least one month in advance of planned event.

8.90.030 No department action until fees are paid in full.

Except as otherwise provided in the county code, the public works department will take no action on an application until the required fees and deposits are paid in full and will take no final action on an application until final costs are paid in full. 8.90.040 Relation to fees and costs required by other departments, agencies, and districts.

Fees required under the provisions of this chapter shall be in addition to application fees and other fees and cost reimbursement required by other departments, agencies, and districts. (Res. 2022-90 (Exh. A), 9/20/22; Res. 2022-70 (Exh. A), 7/19/22; Res. 2014-26 (Att. A (part)), 3/11/14).

8.90.050 Extraordinary circumstances—Waiver or reduction of fees.

The director is authorized to exercise discretion to waive or reduce individual fees on a case-by-case basis for unique or extraordinary circumstances upon written petition of the applicant. The director’s determination regarding what qualifies for waiver or reduction of fees shall be final. (Res. 2022-90 (Exh. A), 9/20/22; Res. 2022-70 (Exh. A), 7/19/22; Res. 2014-26 (Att. 8.90.060 Relation to financial assurance.

Fees required under the provisions of this chapter are not included in, and do not satisfy, any requirement for financial assurance, including bonding, insurance, or other form of financial assurance, which may be required as a condition of any permit, franchise, license, agreement, order, resolution, or plat. 8.90.070 Refunds.

If an application is withdrawn, the county will refund the unexpended portion of the applicant’s fees and deposits. (Res. 2022-90 (Exh. A), 9/20/22; Res. 2022-70 (Exh. A), 7/19/22; Res. 2014-26 (Att. A (part)), 3/11/14).

8.90.080 Effective date.

8.90.090 Severability.

If any provision of this chapter or its application is held invalid, illegal, or unconstitutional, in whole or in part, by any court or agency of competent jurisdiction, said decision shall not affect the validity of the remainder of the chapter.
