13.28.010 Findings of fact.

(1) A method used to mitigate the loss of fish habitat for projects located on Lake Chelan is to anchor large woody debris to the floor of Lake Chelan.

(2) It has been determined that the current methods used for the anchoring of large woody debris to the floor of Lake Chelan have obstructed the navigable capacity of Lake Chelan, which may cause a significant hazard to the safety of the public utilizing Lake Chelan.

(3) Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) no obstructions may be created that would interfere with the navigable capacity of any of the waters of the United States.

(4) Lake Chelan is used by the public as a navigable waterway.

(5) In order to ensure the safety of the public when using and navigating on Lake Chelan, it was determined that a clear definition should be created for large woody debris when being used as a method for mitigation for the potential loss of fish habitat for projects on Lake Chelan. 13.28.020 Conclusions.

(1) For purposes of this chapter the term “large woody debris” will be defined as follows: “For those projects in Lake Chelan which employ woody material structures as compensatory mitigation, the woody material structures shall not extend more than twelve inches from the lake bed. All such structures shall be placed landward of and as close to the one-thousand-seventy-nine-foot elevation as possible.”

(2) The definition of “large woody debris” shall not apply to shoreline stabilization projects.

(3) The adoption of these findings of fact and conclusions of law is in the best interest of the public and further the health, safety, and welfare of the citizens of Chelan County. (Res. 2015-25 (part), 2/17/15).

13.28.030 Effective date.

This chapter shall take effect and be in force from and after February 17, 2015. This chapter does not apply to land use applications deemed complete, or any permits associated with said applications, prior to the ratification of the resolution codified in this chapter.
