5.45.080 License—Issuance and denial.

Within twenty-five (25) working days of acceptance for filing of an application, the Planning Manager shall classify the types of adult entertainment activity proposed by the applicant within the categories set forth in Section 5.45.020 (1) and shall grant or deny an adult entertainment license to the applicant and give written notice to the applicant of his or her decision. The Planning Manager shall issue an adult entertainment license to the applicant unless one or more of the following conditions exist:

(1)    The adult entertainment enterprise fails to meet the location requirements set forth in Section 5.45.140 of this chapter;

(2)    Exterior, signage and interior plans fail to demonstrate compliance with applicable requirements of Sections 5.45.150 and 5.45.160;

(3)    The intended operator, any owner, or any present or intended employee has, within the twenty-four (24) month period preceding the filing of the application, been convicted of any of the following offenses:

(a)    Promoting pornography, RCW 9.68.140,

(b)    Rape in the first degree, RCW 9A.44.040,

(c)    Rape in the second degree, RCW 9A.44.050,

(d)    Rape in the third degree, RCW 9A.44.060,

(e)    Statutory rape in the first degree, RCW 9A.44.070,

(f)    Statutory rape in the second degree, RCW 9A.44.080,

(g)    Statutory rape in the third degree, RCW 9A.44.090,

(h)    Indecent liberties, under either RCW 9A.44.100 (l)(a) or 9A.44.100 (1)(b),

(i)    Indecent exposure, RCW 9A.88.010,

(j)    Prostitution, RCW 9A.88.030,

(k)    Promoting prostitution in the first degree, RCW 9A.88.070,

(l)    Promoting prostitution in the second degree, RCW 9A.88.080,

(m)    Permitting prostitution, RCW 9A.88.090,

(n)    Distributing controlled substance to minors, RCW 69.50.406, or

(o)    A substantially similar offense under the laws of another state;

(4)    The applicant failed to supply all the information required on the application;

(5)    The applicant knowingly gave materially false, fraudulent or untruthful information on the application;

(6)    The applicant, operator, or any owner has, within one (1) year of the date of filing of application, had an adult entertainment license revoked under this chapter or a substantially similar ordinance or law. (Sec. 3 of Ord. 1990-08-03)
