14.08.170 UPC 103.3.5 amended

Section 103.3.5 of the UPC is amended to read:

The administration authority may, in writing, suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of incorrect information supplied, or in violation of any ordinance or regulation or any of the provisions of this code; provided, that such revocation shall not be effective until after a fair and impartial hearing has been held before the Clark County Land Use Hearings Examiner for which notice has been given to the permittee; provided further that a court of competent jurisdiction may issue a temporary restraining order, a preliminary injunction or a permanent injunction prior to or in the absence of the hearing; and provided, further, that any permittee who expends time, money and effort after a notice of revocation shall assume the risk of the cost of the expenditure.
