24.09.040 New, converted or remodeled establishments.

(1)    Any person who intends to operate a food establishment shall submit to Clark County public health properly prepared facility plans and specifications for review and approval before:

(a)    The construction of a food establishment;

(b)    The conversion of an existing structure for use as a food establishment; or

(c)    The remodeling of or a change of type of a food establishment or food operation, if Clark County public health determines that plans and specifications are necessary to ensure regulatory compliance.

(2)    Clark County public health may issue a permit to the applicant after:

(a)    An application is obtained from and submitted to Clark County public health;

(b)    The established fee is submitted as set out in the Clark County public health fee schedule;

(c)    The facility operational plans and specifications are reviewed and approved; and

(d)    Clark County public health conducts one or more preoperational inspections to verify that the food establishment is constructed and equipped in accordance with the approved plans and approved modifications of those plans, has established standard operating procedures as specified under Chapter 246-215 WAC and is in compliance with all applicable regulations.
